Florida’s HB189 is on track to fully ban sweepstakes casinos as it clears its second committee

Gambling laws in the Sunshine State are about to get stricter after HB189 successfully hurdled its second committee last Wednesday. Filed last October 15th, 2025, Rep. Dana Trabulsy’s bill aims to redefine illegal gambling and strengthens the penalties for violators. 

Although the bill doesn’t directly named “sweepstakes casinos”, the language puts the popular platforms at risk since they look and feel like “casino-style games". 

If the bill continues to gain favorable opinions from legislators, full regulation will take effect on October 1, 2026.

HB189 Redefines “Illegal Gambling”, Highlights Penalties for Violators

The latest hearing has polished the definition of “internet gambling”, as an activity where a “money or other thing of value is awarded based on chance”, and that it simulates casino games, such as slots and table games.

This broad definition may push regulators to argue that sweepstakes casinos offer a “thing of value”, such as real-world prizes like cash and coins.

If approved as written, the industry can expect the following:

  • Playing or participating in “internet gambling” is categorized as second-degree misdemeanor

  • In sports wagering, first offense is a second-degree misdemeanor, with harsher penalties for repeat offenders

  • For players based in Florida, the possible approval of the law could mean the following:

  • Many sweepstakes casino operators may now geo-block the state, restrict redemptions, or announce their exits

  • Account restrictions could happen, with fewer promos and campaigns as operators react and adapt to changing regulations

The biggest changes and impact will happen on the operators’ side. 

According to HB189, any entity that operates, conducts, or promotes illegal gambling activities would face third-degree felony. Even the advertisements are subject to regulations. Violators of this rule will face a first-degree misdemeanor on the first offense, with harsher penalties for repeat offenders.

Also, influencers, affiliates, and other content creators should start paying attention to the bill’s recent developments. Now, marketing becomes risky, and they face serious charges depending on the type of content published.

As of January 16th, HB189 sits in the House’s Commerce Committee.
