Virginia Delays Sweepstakes Casino Ban as Industry Review Takes Centre Stage

Virginia lawmakers have decided to delay a proposed ban on sweepstakes casinos, opting to study the industry instead of moving forward with immediate restrictions.

Senate Bill 579 (SB 579), which originally aimed to prohibit certain sweepstakes casino platforms, has now been carried over to the 2027 legislative session. Rather than introducing an outright ban, lawmakers have chosen to gather more information before deciding how the state should regulate theis sector.

Proposed Ban Put On Hold

The original version of SB 579, introduced by State Senator Bryce Reeves, aimed to classify many dual currency sweepstakes casinos as illegal gambling operations under Virginia law.

If passed in its original form, operators found to be in breach of the legislation could have faced civil penalties ranging from $10,000 to $100,000 per violation. The proposal showed a trend across the United States, where several states have introduced legislation targeting sweepstakes casino operators.

Instead of advancing those measures, the Virginia Senate Courts of Justice Committee approved a substitute version of the bill that removes the immediate ban and replaces it with an in depth industry review.

Virginia Lottery Board to lead industry study

Under the revised legislation, the Virginia Lottery Board will establish a work group made up of industry stakeholders and other interested parties to examine the sweepstakes casino market.

The group will assess the legal, economic, technological, and public policy implications of interactive online sweepstakes games. It will also look at how these platforms operate as promotional products, explore the differences between sweepstakes casinos and traditional online gambling, and work towards creating a clearer legal definition for the sector.

The work group's findings must be submitted to the relevant House and Senate committees by 1 December 2026, with the report expected to play a key role when lawmakers revisit the issue during the 2027 legislative session.

Operators Can Continue Serving Virginia Players

For now, the decision means sweepstakes casino operators can continue offering their services to players in Virginia under the state's existing legal framework.

The move makes Virginia something of an outlier compared to other states that have opted for bans or stronger enforcement measures against sweepstakes casinos. Instead, lawmakers are taking a wait-and-see approach while gathering more information about how the industry operates.

The industry review leaves several possibilities on the table. Once lawmakers receive the Lottery Board's recommendations, they could decide to move forward with an outright ban, introduce a regulatory framework, or pursue an alternative approach based on the study's findings.
