Are sweepstakes casinos legal in Colorado?

Sweepstakes casinos are legal to play in Colorado, and the major brands accept Colorado players. No Colorado statute names online sweepstakes casinos, the Division of Gaming and the Attorney General have not issued cease-and-desist letters to any operator, and no bill to ban the model has been introduced in Denver.

Section 18-10-102 of the Colorado Revised Statutes defines gambling as risking money, credit, deposit or any other thing of value for gain contingent in whole or part on lot, chance or the outcome of an event, and it excludes bona fide business transactions, social gambling and every form of gambling the state regulates: limited gaming, the lottery, sports betting, pari-mutuel racing and charitable bingo and raffles. Sweepstakes casinos rely on the consideration element. Because Sweeps Coins can be obtained free through daily bonuses, social giveaways and mail-in requests, players are not risking anything of value, so the games sit outside the definition. Colorado also regulates prize promotions generally under Sections 6-1-801 to 6-1-804 of the Consumer Protection Act, which govern how sweepstakes and their odds must be disclosed but do not restrict the dual-currency model.

Colorado does have a history with sweepstakes-branded gambling. In October 2014 Attorney General John Suthers issued Formal Opinion 14-03 finding that internet sweepstakes cafes, storefronts where customers bought internet time and played slot-style games for prizes, were illegal gambling. The Legislature followed with HB 15-1047, signed by Governor John Hickenlooper on March 13, 2015, which created Article 10.5 of Title 18 and outlawed simulated gambling devices offered for payment and prizes, with misdemeanor penalties and civil actions by the Attorney General or district attorneys for up to three times the amounts involved. Those provisions were written for physical premises and have never been applied to online sweepstakes casinos.

Recent developments

  • 2025 session: no bill mentions sweepstakes casinos. Colorado stays out of the wave of bans passed in Montana, Connecticut, New Jersey and New York.
  • April 2026: SB 26-131 is introduced to tighten online sports betting. A proposed ban on player prop bets is dropped, but the bill passes the House in May.
  • May 29, 2026: Governor Jared Polis signs SB 26-163. From August 12, 2026 Division of Gaming investigators may inspect, hold or impound any premises where unlicensed gaming or sports betting is suspected. The act also moves racing regulation under the Limited Gaming Control Commission and expands the sports betting self-exclusion programme. It addresses physical premises and does not mention online sweepstakes.
  • June 1, 2026: Governor Polis signs SB 26-131. From August 12, 2026 sportsbooks may not accept credit card deposits, must limit players to six deposits a day, may not use push notifications for gambling marketing or advertise to minors, and face fines of up to $25,000 per violation.
  • September 2026: no enforcement action against any sweepstakes casino, and every major brand continues to accept Colorado players.

How Colorado law treats sweepstakes and gambling

Under Section 18-10-103, gambling by a player is a petty offence, while professional gambling, meaning running or profiting from an unlicensed gambling business, is a class 1 misdemeanor that becomes a felony for repeat offenders. The Division of Gaming in the Department of Revenue and the Limited Gaming Control Commission regulate the casinos and sports betting, the Colorado Lottery runs the lottery, and the Attorney General enforces consumer protection law. Colorado has never prosecuted a player for using an online sweepstakes casino, and the sites remain unregulated: neither licensed by the Division of Gaming nor prohibited.

What Colorado players should check

  • Age: most sweepstakes casinos accept Colorado players aged 18 and over; Stake.us requires 21. Colorado casinos and sportsbooks are 21+, and the lottery is 18+.
  • Eligible states: Colorado is on almost every operator’s list, but confirm it in the terms before buying Gold Coins.
  • Location and identity: sites geolocate you and require KYC verification before your first redemption. VPN use forfeits balances.
  • No state cap: Colorado imposes no prize registration threshold or redemption limit, so operator limits are the only ones that apply.
  • No regulator: payout disputes cannot be taken to the Division of Gaming. Complaints about misleading promotions go to the Attorney General’s consumer protection section.
  • Taxes: prizes are taxable income for federal and Colorado purposes.

Other legal ways to play in Colorado

Colorado has allowed casino gaming in the historic mining towns of Black Hawk, Central City and Cripple Creek since 1991, and roughly thirty casinos operate there today; Amendment 77, approved in 2020, let the towns remove bet limits and add new games. The Southern Ute and Ute Mountain Ute tribes run Sky Ute Casino Resort in Ignacio and Ute Mountain Casino in Towaoc. Online and retail sports betting launched on May 1, 2020 after voters approved Proposition DD in November 2019, and around twenty sportsbook apps are licensed. The Colorado Lottery has operated since 1983, daily fantasy sports has been licensed since 2016, and charitable bingo and raffles are permitted. Colorado has no legal online casino, and the casino towns have opposed proposals to create one.

Staying up to date

We monitor Colorado bill filings, Division of Gaming and Attorney General announcements and every operator’s Colorado terms. Colorado sweepstakes casino FAQs

Are sweepstakes casinos legal in Colorado?

Yes. No Colorado statute bans online sweepstakes casinos and no state agency has taken action against one. Because Sweeps Coins can be obtained without a purchase, players are not risking anything of value under Section 18-10-102, so the sites fall outside the gambling definition. Every major brand accepts Colorado players.

Did Colorado’s 2026 gambling laws affect sweepstakes casinos?

No. SB 26-131 tightened online sports betting from August 12, 2026 by banning credit card deposits and limiting marketing, and SB 26-163 gave Division of Gaming investigators power to inspect premises suspected of unlicensed gaming. Neither law mentions online sweepstakes casinos or changes their status.

Are internet sweepstakes cafes legal in Colorado?

No. Attorney General John Suthers found in 2014 that sweepstakes cafes were illegal gambling, and HB 15-1047, signed on March 13, 2015, outlawed simulated gambling devices offered for payment and prizes at physical premises. Those rules were written for storefronts and have not been applied to online sweepstakes casinos.

How old do I have to be to play sweepstakes casinos in Colorado?

Most sweepstakes casinos accept Colorado players aged 18 and over, while Stake.us and a few others require 21. Colorado’s casinos and sportsbooks are 21+, and the lottery is 18+. Check the age rule in each site’s terms and expect an identity check before your first redemption.

Are online casinos legal in Colorado?

No. Colorado allows online sports betting, live since May 1, 2020, and licensed daily fantasy sports, but not online casino games. Legal casino play is limited to the casinos in Black Hawk, Central City and Cripple Creek and the two tribal casinos in the southwest of the state.
