Are sweepstakes casinos legal in Utah?

Utah has never permitted any form of gambling, and since May 6, 2026 its criminal code expressly treats casino-style promotional games as "fringe gambling", so the standard Gold Coins and Sweeps Coins model is on very thin ice in the state. Article VI, Section 27 of the Utah Constitution says the Legislature "shall not authorize any game of chance, lottery or gift enterprise under any pretense or for any purpose". Utah is one of only two states, with Hawaii, that has no lottery, no casinos, no racetrack betting and no legal sports wagering.

The gambling statutes sit in Utah Code Title 76, Chapter 9, Part 14. Gambling means risking anything of value on a game of chance, or on an event outside the player’s control, for a return. Since 2013 Utah has also outlawed "fringe gambling": any de facto gambling, lottery or gaming device that a business offers in exchange for anything of value or incidental to another purchase. That clause closed the state’s internet-sweepstakes cafes. Its exemption for promotional activity "clearly ancillary" to a business’s real trade was the hook sweepstakes casinos relied on.

HB 243 (Gambling Revisions), sponsored by Rep. Joseph Elison of Toquerville with Sen. Brady Brammer carrying it in the Senate, rewrote that exemption. Under the amended Section 76-9-1401 a promotion is not "clearly ancillary" if it simulates a gambling environment, requires the purchase of something of value to take part, delivers the purchased good only at a delayed or discounted value, or runs on displays that imitate video poker, video bingo, slot reels or a video game that reveals a prize. The bill also defined "sweepstakes", "online gambling" and "proposition bet", the last aimed squarely at prediction markets. A dual-currency casino ticks most of those boxes. That is why we class Utah as limited: the model is legally untenable, yet a number of sites still accept Utah sign-ups and nobody has been prosecuted. Recent developments

• February 10, 2026: HB 243 passes the Utah House 63-9.
• February 11, 2026: the bill stalls in the Senate Rules Committee over federal pre-emption worries and concern that its definitions could catch ordinary retail promotions.
• Late February 2026: prediction-market operator Kalshi sues Governor Spencer Cox and state officials in federal court, arguing its event contracts are regulated exclusively by the Commodity Futures Trading Commission.
• March 25, 2026: after a Senate rewrite, Governor Cox signs HB 243.
• May 6, 2026: HB 243 takes effect. The Kalshi litigation continues.
• Summer 2026: operator policies diverge. Some brands quietly remove Utah from their eligible-state lists; others, including several of the largest, still accept residents. No operator has been charged and no cease-and-desist letters have been made public.

How Utah law treats sweepstakes and gambling

Utah has no gaming commission and no lottery, so there is no regulator to license, tax or field complaints about gaming of any kind. Enforcement falls to the Utah Attorney General and county attorneys.

• Players: unusually, Utah’s statute criminalises participation, not just operation. Gambling is a class B misdemeanor, rising to class A for repeat offences. We know of no prosecution of an online sweepstakes player, but the exposure is real on paper.
• Operators and promoters: running or promoting a gambling business, or offering fringe gambling, carries heavier penalties, reaching felony level for repeat conduct. HB 243’s definitions make it far harder for a casino-style site to argue it is a mere promotion.
• Civil recovery: Utah law also gives people who lose money to illegal gambling a civil route to recover it.
• Free-to-play: social casinos with no purchases and no prizes are outside the gambling definition entirely.

What Utah players should check

• Eligibility: look for Utah in the site’s list of eligible states. If a brand removed Utah after May 2026, do not try to work around it.
• Age: at least 18 everywhere, and most Utah-facing brands set 21+.
• Location: geolocation checks are standard. A VPN breaches the terms and forfeits balances.
• Identity checks: expect KYC before a first redemption.
• No safety net: with no state gaming regulator, a dispute with an operator can only go to the operator itself or a court.

Other legal ways to play in Utah

There are none. Utah has no lottery (residents drive to Idaho, Wyoming or Colorado border towns for tickets), no commercial or tribal casinos, no pari-mutuel wagering, no charitable bingo or raffles for money, and no legal sports betting. Daily fantasy sites treat Utah as a closed state, and HB 243 was written partly to keep prediction markets out as well. Free-play social casinos remain available.
