Are sweepstakes casinos legal in Montana?

No. Montana banned online sweepstakes casinos with Senate Bill 555, which took effect on October 1, 2025, and every major dual-currency brand has stopped serving the state. Montana was the first state in the country to legislate directly against the Gold Coins and Sweeps Coins model, months before California, Connecticut, New Jersey or New York acted.

Montana defines gambling the way most states do: a game of chance, played for a prize, with consideration. Sweepstakes casinos argued that they fell outside the definition because Sweeps Coins are handed out free with a purchase of Gold Coins or through mail-in and daily-login entries, so nothing of value is risked. SB 555, sponsored by Senator Vince Ricci, closed that argument by rewriting the definition of internet gambling in Title 23, chapter 5 of the Montana Code Annotated. The new language says internet gambling includes online casinos, by whatever name known, and covers any platform, website or application that knowingly transmits or receives gambling information, allows consumers to place a bet or wager using any form of currency, and makes payouts of any form of currency. The phrase any form of currency was written to catch Sweeps Coins and cryptocurrency alike.

The bill passed the Senate 40-8 in early April 2025 and the House 88-11 later that month. Governor Greg Gianforte signed it on May 12, 2025, and it became effective on October 1, 2025.

The law carves out online casinos that do not allow the use of currency of any kind. A pure free-play social casino, where you can buy or earn coins but can never redeem anything, is therefore still permitted. The Montana Lottery, Sports Bet Montana, licensed live-card-game and video-gambling-machine operators, licensed simulcast facilities and nonprofit raffles are also unaffected. Recent developments

• March 2025: SB 555 is introduced. Senator Ricci says it gives the Department of Justice sharper tools against unregulated online operators that pay no Montana gambling tax and answer to no Montana regulator.
• April 2025: the Senate passes the bill 40-8 and the House follows 88-11.
• Spring 2025: VGW closes Chumba Casino, LuckyLand Slots and Global Poker to Montana players before the bill is even signed.
• May 12, 2025: Governor Gianforte signs SB 555. The Social and Promotional Games Association calls it a law so broadly written it fails to name what it bans and warns that everyday digital reward programs could be caught.
• Summer 2025: McLuck, Pulsz, WOW Vegas, NoLimitCoins, Funrize and the other large brands announce Montana exit dates and tell players to redeem balances before October 1.
• October 1, 2025: the ban takes effect. Operators geo-block Montana IP addresses and freeze remaining accounts.
• 2026: the Montana Legislature meets only in odd-numbered years, so no repeal or amendment can be considered before the 2027 session. Nothing has been pre-filed.

How Montana law treats sweepstakes and gambling

Gambling in Montana is regulated by the Gambling Control Division of the Montana Department of Justice under the Montana Gambling Control Act, Title 23, chapter 5 of the Montana Code Annotated. Montana is unusual in allowing bars and taverns to hold up to 20 video gambling machines each, which is why the word casino in Montana usually means a licensed bar rather than a resort.

Internet gambling has been illegal in Montana for years; SB 555 simply made clear that sweepstakes-style online casinos are inside the definition. Knowingly operating an illegal internet gambling platform is a felony punishable by up to 10 years in prison and a fine of up to $50,000 per offence. The statute is aimed at the companies that run and profit from the platforms. We are not aware of any Montana player being prosecuted for using a sweepstakes casino, and the operators, not their customers, were the target of the debate in Helena.

What Montana players should check

• Any site paying out prizes to Montanans is operating illegally. Since October 1, 2025, a casino that still lets you redeem Sweeps Coins for cash or gift cards while you are in Montana is either ignoring the law or does not know where you are. Treat it as a red flag.
• Free-play social casinos are fine. If a site has no redemption of any kind, SB 555 does not apply to it.
• Age: Montana sets 18 as the minimum age for every form of legal gambling, from lottery tickets to video gambling machines, and 18 is the age sweepstakes sites used before the ban.
• Geolocation and VPNs: operators verify your state. Using a VPN to reach a casino that has left Montana breaches its terms, and accounts caught doing so are closed with balances forfeited.
• Old balances: if you still hold Sweeps Coins with a casino that left, contact its support team about redemption or a refund of unused purchases.

Other legal ways to play in Montana

Montana has more legal gambling per head than almost any state, just not online. About 1,400 licensed locations offer roughly 16,500 video gambling machines running video poker, keno and bingo, with a $2 maximum bet and an $800 maximum payout per game. Seven tribal nations operate casinos on their reservations under state compacts. Licensed venues also run live poker and other card games.

The Montana Lottery sold its first ticket on June 24, 1987. Its Sports Bet Montana product launched on March 9, 2020 and is the only legal sportsbook in the state; you bet through kiosks or an app that works only while you are inside a licensed retailer, so there is no statewide mobile betting. Pari-mutuel wagering on horse racing is legal at licensed tracks and simulcast venues. There is no legal online casino, online poker or online lottery in Montana.
