Are sweepstakes casinos legal in Ohio?

Yes. Sweepstakes casinos are legal to play in Ohio, and no statute or regulator action currently targets the dual-currency model. Ohio’s gambling law (Ohio Revised Code Chapter 2915) prohibits games of chance and schemes of chance that are played for valuable consideration. The same chapter contains one of the country’s more detailed statutory definitions of a sweepstakes: any game, contest, advertising scheme or promotion where consideration is not required to enter or to become eligible for a prize, the determination of which is based on chance. Online sweepstakes casinos rely on exactly that carve-out. Gold Coins are sold for entertainment only; Sweeps Coins are given away free with purchases, through daily bonuses, social promotions and mail-in requests. Because no purchase is required to obtain the prize-eligible currency, the consideration element of gambling is missing.

Ohio has dealt with sweepstakes before, in a different form. In 2013 the General Assembly cracked down on storefront internet cafes by regulating sweepstakes terminal devices: operators must register with the Attorney General and may not hand out merchandise prizes worth more than ten dollars per entry. Those rules apply to physical terminals at Ohio locations, not to websites and apps run from outside the state, which is why online sweepstakes casinos continue to accept Ohio players. Every major brand currently serves Ohio.

Recent developments

  • May 2025: Senator Nathan Manning introduces Senate Bill 197 to legalise online casino gaming and iLottery under the Ohio Casino Control Commission. On May 20, 2025, Representative Brian Stewart introduces House Bill 298, which would legalise iGaming for Ohio’s existing casinos and racinos (a $50 million licence fee and a 28 percent tax) and explicitly prohibit online sweepstakes games at the same time.
  • Autumn 2025: legislative leaders signal that neither bill will move before the end of the year. Governor Mike DeWine says he is “not for” real-money online casino gaming, describing it as putting a casino in everybody’s hands 24-7, and House Speaker Matt Huffman is also cool on further gambling expansion. The sweepstakes ban, tied to the iGaming package, stalls with it.
  • January 2026: local press describes Ohio gaming legislation as in limbo, with no hearings scheduled on HB 298 or SB 197.
  • April 2026: the Ohio Casino Control Commission issues cease-and-desist orders to three prediction-market platforms over unlicensed sports wagering. The action does not touch sweepstakes casinos.
  • September 2026: Stewart revisits HB 298 with revisions that would steer online promotional credits toward redemption at brick-and-mortar casinos and racinos. Coverage notes the bill still faces gubernatorial opposition and may be reintroduced after a new governor takes office in January 2027.

How Ohio law treats sweepstakes and gambling

Chapter 2915 of the Ohio Revised Code is the relevant statute. Section 2915.02 makes it an offence to engage in bookmaking, to operate a game or scheme of chance for profit, to bet or play games of chance as a substantial source of income, or to run sweepstakes terminal devices outside the registration and ten-dollar prize rules. A first offence is a first-degree misdemeanor; a repeat conviction is a fifth-degree felony. Casual players of a genuine no-purchase-necessary sweepstakes are not committing an offence, because the statute’s own definition of a sweepstakes removes the consideration element.

Two regulators matter. The Ohio Casino Control Commission licenses the state’s four commercial casinos, all sports betting and fantasy contests; the Ohio Lottery Commission runs the lottery and the video lottery terminals at the seven racinos. Neither agency licenses or audits sweepstakes casinos, so consumer protection falls to each operator’s own terms and to general consumer law enforced by the Attorney General. We are not lawyers; if you have a specific concern, read the statute or ask one.

What Ohio players should check

  • Age: most sweepstakes casinos accept Ohio players from 18, although a few set 21 to match the casino and sports betting age. Check the terms before you register.
  • Location: sites geolocate you at login and at redemption. You need to be physically in a state the operator serves; VPN use breaches the terms and forfeits balances.
  • Identity checks: expect to upload ID and proof of address before your first Sweeps Coins redemption. Minimum redemptions are typically 50 to 100 Sweeps Coins.
  • Taxes: prizes are taxable income federally and in Ohio; operators issue tax forms above the reporting thresholds.
  • Watch the calendar: if HB 298 or a successor bill moves, the sweepstakes prohibition would come with an effective date and operators would announce exit deadlines. Redeem before any such date.

Other legal ways to play in Ohio

Ohio has four commercial casinos (Hollywood Columbus, Hollywood Toledo, Hard Rock Cincinnati and JACK Cleveland) and seven racinos with video lottery terminals, all 21 and over. Legal online and retail sports betting launched on January 1, 2023, in what the Casino Control Commission called the largest simultaneous sports gaming launch in US history. The Ohio Lottery offers draw and scratch games from age 18 and runs sports-gaming kiosks in bars and restaurants. Charitable bingo is licensed by the Attorney General. There is no legal real-money online casino or online poker in Ohio; HB 298 and SB 197 would change that if they ever pass.

Staying up to date

Stakester tracks HB 298, SB 197 and any new Ohio bill or Casino Control Commission action, and checks each operator’s Ohio policy. The list and status on this page are updated as soon as something changes.

Ohio sweepstakes casino FAQs

Are sweepstakes casinos legal in Ohio?

Yes. Ohio has no law targeting online sweepstakes casinos, and the Revised Code’s own definition of a sweepstakes (no consideration required to enter, prize decided by chance) is what the dual-currency model relies on. No regulator has sent cease-and-desist letters, and all major brands accept Ohio players.

Is there a bill to ban sweepstakes casinos in Ohio?

House Bill 298, introduced by Representative Brian Stewart in May 2025, would legalise online casinos for existing Ohio operators and prohibit online sweepstakes games. It stalled in late 2025 amid opposition from Governor DeWine and House leadership. Stewart floated a revised version in September 2026, but nothing has passed either chamber.

Can I get in trouble for playing at a sweepstakes casino in Ohio?

No. Ohio Revised Code 2915.02 targets bookmakers, operators of schemes of chance and people who gamble as a substantial source of income. Playing a genuine no-purchase-necessary sweepstakes is not gambling under the statute, and no Ohio player has faced action for using these sites.

How old do I have to be to play sweepstakes casinos in Ohio?

Most sweepstakes casinos accept Ohio players from 18, which matches the Ohio Lottery age. A few brands apply 21, the age for Ohio’s casinos, racinos and sports betting. Every site verifies your age and identity before your first prize redemption.

Is online casino gambling legal in Ohio?

Not yet. Ohio legalised online and retail sports betting on January 1, 2023, but real-money online casinos and online poker remain illegal. HB 298 and SB 197 would legalise iGaming for the state’s four casinos and seven racinos, but both bills have stalled and the Governor opposes them.
