Are sweepstakes casinos legal in Wyoming?

Wyoming is a grey state that is turning greyer. No statute bans sweepstakes casinos, no enforcement action has been taken and most major brands accept Wyoming players, but the Wyoming Gaming Commission says every online casino and sweepstakes site is "operating illegally", and legislators are drafting a bill to make running one a felony from July 2027.

Wyoming Statute 6-7-101(a)(iii) defines gambling as risking any property for gain contingent in whole or in part upon lot or chance in any game played with cards, dice, balls or on any gambling device, or on the outcome of an event the player cannot control. The definition lists exceptions: games incidental to a bona fide social relationship, charitable raffles, pari-mutuel wagering, the WyoLotto lottery, skill-based amusement games and online sports wagering. Sweepstakes casinos argue that a player who receives Sweeps Coins free is not "risking property". The Legislative Service Office’s own staff comment on the 2026 draft bill acknowledges the open questions: whether promotional currency is property, whether simulated games are covered, and whether the law clearly reaches operators and their service providers. Until a court or the Legislature answers them, the model sits outside any licence but inside a genuine legal gap. We are not lawyers; check each site’s Wyoming terms before you play.

Recent developments

  • February 2025: HB 162, Rep. Robert Davis’s bill to legalise and tax online casinos at 16 percent, dies when no member of the Joint Travel, Recreation, Wildlife and Cultural Resources Committee seconds a motion to advance it.
  • May 22, 2025: the Gaming Commission warns residents that "no online casino, iGaming, or sweepstakes site is licensed by the Wyoming Gaming Commission, and they are all operating illegally in Wyoming", adding that it cannot help with disputes over unlicensed winnings.
  • February 20, 2026: Senate File 44, brought by the Management Council for the Select Committee on Gaming chaired by Sen. John Kolb, passes the Senate 31-0. It tightens the "bona fide social relationship" exception so nobody may take remuneration other than winnings, and requires charitable raffles to devote 100 percent of net proceeds to charity.
  • March 3 and 6, 2026: the House passes SF 44 58-0 and Governor Mark Gordon signs it (Chapter 51). It takes effect July 1, 2026.
  • July 30, 2026: in Casper, the Select Committee on Gaming reviews working draft 27LSO-0098, "Online casinos and sweepstakes prohibited". It would add operating an online casino or sweepstakes game, and knowingly supplying geolocation, payment, hosting, content or advertising services to one, to the definition of professional gambling, a felony carrying up to three years and $3,000. A new "representative of value" definition covers single-, dual- and multi-currency systems. Players are expressly excluded. VGW’s lawyers argue the definitions would catch ordinary retail promotions. The committee lays the draft back, asks the Gaming Commission for data and the LSO for other states’ laws, and will return to it later in the interim.
  • September 15, 2026: the Commission and Bally’s announce that the Bally’s Cheyenne Park live racing venue, due to open in October, is postponed to 2027.

How Wyoming law treats sweepstakes and gambling

  • Players: gambling is a misdemeanor under W.S. 6-7-102(a), punishable by up to six months in jail and a $750 fine. Nobody has been charged for playing a sweepstakes casino, and the 2027 draft would formally exempt players.
  • Operators: professional gambling, aiding or inducing others to gamble for profit, is already a felony under 6-7-102(b): up to three years and $3,000. The draft bill simply names online casino and sweepstakes operation as professional gambling so that existing seizure powers over gambling devices, records and proceeds apply.
  • Regulator: the Wyoming Gaming Commission oversees pari-mutuel and historic horse racing wagering, online sports wagering, skill-based amusement games and charitable gaming. It licenses no sweepstakes casino and has said plainly it will not intervene in disputes with one.

What Wyoming players should check

  • Age: Wyoming sets 18 for sports betting and the lottery, and sweepstakes sites accept Wyoming players from 18, though several brands set 21+.
  • Location: geolocation is enforced and a VPN breaches the terms.
  • No regulator backstop: if an operator withholds a redemption, the Gaming Commission cannot help. Choose established brands and redeem regularly rather than holding large balances.
  • Identity checks: expect KYC before a first redemption.
  • Watch 2027: if the draft becomes a bill in the general session that opens in January 2027, operators would have until July 1, 2027 to leave. We will flag any change here.

Other legal ways to play in Wyoming

Wyoming has more legal gambling than its size suggests. Four tribal casinos operate on the Wind River Reservation: Wind River Hotel and Casino, Shoshone Rose Casino and Hotel, Little Wind Casino and 789 Casino. Online sports betting launched on September 1, 2021 for players 18 and over, with half a dozen apps including DraftKings, FanDuel, BetMGM and Caesars. Historic horse racing terminals fill off-track betting parlours across the state, licensed skill-based amusement games sit in bars and truck stops, WyoLotto has sold draw games since 2014, and nonprofits run bingo and raffles under the rules tightened by SF 44. There is no legal online casino, and HB 162 showed little appetite for one.

Staying up to date

We follow the Select Committee on Gaming, the 2027 general session, Gaming Commission notices and every operator’s Wyoming policy. The legal status and casino list on this page are updated as soon as anything changes; the review date in the header shows when we last checked.

Wyoming sweepstakes casino FAQs

Are sweepstakes casinos legal in Wyoming?

They are unregulated rather than authorised. No statute bans them and no enforcement action has been taken, so major brands accept Wyoming players. But the Gaming Commission said in May 2025 that all such sites are operating illegally, and a draft bill to make operating one a felony is before the Select Committee on Gaming.

What would the Wyoming draft bill do?

Working draft 27LSO-0098 would add operating an online casino or sweepstakes game, and knowingly providing payment, geolocation, hosting or advertising services to one, to professional gambling, a felony carrying up to three years and $3,000. It defines dual-currency systems as representatives of value, exempts players and would take effect July 1, 2027.

Can Wyoming players be prosecuted?

Gambling is a misdemeanor in Wyoming, but nobody has been charged for playing at a sweepstakes casino and the 2027 draft expressly excludes participation solely as a player. The practical risk is different: the Gaming Commission cannot help if an unlicensed site refuses to pay.

What did Senate File 44 change in 2026?

SF 44, signed March 6, 2026 and effective July 1, 2026, tightened the social-gambling exception so games must be private, unadvertised, between people with a genuine relationship, and free of anyone taking remuneration other than winnings. It also required charitable raffles to give all net proceeds to charity. It did not mention sweepstakes casinos.

What legal gambling does Wyoming offer?

Four tribal casinos on the Wind River Reservation, online sports betting since September 2021 for players 18 and over, historic horse racing terminals, skill-based amusement games, WyoLotto since 2014, live racing and charitable bingo and raffles. Real-money online casinos are not legal; a 2025 bill to allow them died in committee.
