Are sweepstakes casinos legal in Wisconsin?

Yes. Wisconsin has no statute, bill or enforcement action aimed at sweepstakes casinos, and every major Gold Coins and Sweeps Coins brand accepts Wisconsin players.

Wisconsin’s constitution (Article IV, Section 24) prohibits the Legislature from authorising gambling except the state lottery, bingo, raffles and pari-mutuel racing; tribal casinos operate under federal law and state compacts. Chapter 945 of the Wisconsin Statutes then defines a "bet" in section 945.01 as a bargain in which the parties agree that, dependent on chance even though accompanied by some skill, one stands to win or lose something of value. The same section lists things that are not bets, including bona fide business transactions and prizes awarded in genuine skill contests. A sweepstakes casino’s position rests on the first element: because Sweeps Coins can always be obtained without buying anything, through mail-in requests, daily bonuses and social promotions, the player never agrees to lose something of value on chance. Gold Coins, which are purchased, cannot be redeemed at all.

No Wisconsin court has ruled on that reasoning and no state agency has challenged it. The 2025-2026 session produced a landmark online sports betting law and a high-profile lawsuit against prediction markets, but nothing on sweepstakes. We are not lawyers; check each site’s Wisconsin terms before you play.

Recent developments

  • November 30, 2021: Oneida Casino near Green Bay opens Wisconsin’s first legal sportsbook after a compact amendment; other tribal casinos follow with retail betting.
  • Late 2025: Assembly Bill 601 is introduced to carve tribal online sports wagers out of the definition of a bet.
  • February 19, 2026: the Assembly passes AB 601 on a voice vote without debate.
  • March 18, 2026: the Senate passes the bill.
  • April 9, 2026: Governor Tony Evers signs it as 2025 Wisconsin Act 247, published April 10. Wagers placed anywhere in Wisconsin count as made on tribal land if the server sits on that land under a compact, so statewide apps become possible once all 11 tribes amend their compacts and secure federal approval. Evers said he would not accept a deal that favoured one tribe over another.
  • April 2026: Attorney General Josh Kaul sues Kalshi, Polymarket, Coinbase, Crypto.com and Robinhood, arguing their sports event contracts are unlicensed sports betting under Wisconsin law. He does not mention sweepstakes casinos.
  • 2026 session: no bill to ban, license or tax sweepstakes casinos or online casinos is introduced.

How Wisconsin law treats sweepstakes and gambling

  • Players: under section 945.02, making a bet, entering a gambling place to bet or conducting a lottery is a Class B misdemeanor (up to 90 days in jail and a $1,000 fine). It is rarely charged and has never been used against online sweepstakes players.
  • Operators: commercial gambling under section 945.03, which covers running a gambling place for profit, taking bets for gain or operating gambling machines, is a Class I felony carrying up to three and a half years and a $10,000 fine.
  • Regulators: the Department of Administration’s Division of Gaming oversees tribal compacts, charitable bingo and raffles and racing; the Wisconsin Lottery sits inside the Department of Revenue; the Department of Justice handles enforcement, as the prediction-market lawsuit shows. No agency licenses or audits sweepstakes casinos, so player protections come from the operator.
  • Tribal exclusivity: Wisconsin’s 11 tribes hold the state’s only casino rights and now its only online sports betting rights. Any future move against sweepstakes casinos would most likely come from that direction, as it did in California and New York.

What Wisconsin players should check

  • Age: 18 is the floor, matching the Wisconsin Lottery; several brands require 21, the age at most tribal casinos.
  • Location: geolocation is enforced. Wisconsin borders Michigan, which the major brands exclude, so expect tight checks near the state line and never use a VPN.
  • Free entry: confirm the site offers a no-purchase route to Sweeps Coins.
  • Redemptions and KYC: minimum redemption amounts and identity verification before the first payout are standard.
  • Taxes: prize redemptions are taxable income federally and in Wisconsin.

Other legal ways to play in Wisconsin

Wisconsin’s 11 federally recognised tribes run more than 20 casinos, from Potawatomi Casino Hotel in Milwaukee and Ho-Chunk Gaming in Madison and Wisconsin Dells to Oneida Casino in Green Bay and Menominee Casino Resort in Keshena. Retail sportsbooks have operated at tribal casinos since Oneida’s launch in November 2021, and statewide mobile betting is expected once compacts are amended under Act 247. The Wisconsin Lottery has sold tickets since 1988, in retail stores only. Nonprofits run bingo and raffles, and daily fantasy sports sites operate in the state without a dedicated law. There is no legal online casino and no active bill to create one.

Staying up to date

We monitor the Wisconsin Legislature, the Department of Justice, tribal compact negotiations and every operator’s Wisconsin policy. This page and the casino list are updated as soon as anything changes, and the review date in the header shows when we last checked.

Wisconsin sweepstakes casino FAQs

Are sweepstakes casinos legal in Wisconsin?

Yes. No Wisconsin statute or bill targets the dual-currency sweepstakes model, no agency has taken enforcement action, and all major brands accept Wisconsin players. Because Sweeps Coins are available without purchase, the games fall outside the statutory definition of a bet in section 945.01.

Did Wisconsin pass any gambling laws in 2026?

Yes. 2025 Wisconsin Act 247, signed by Governor Evers on April 9, 2026, allows statewide online sports betting run by the 11 tribes once compacts are amended and federally approved. Attorney General Kaul also sued prediction markets in April 2026. Neither touched sweepstakes casinos.

Can Wisconsin players be punished for using a sweepstakes casino?

Making a bet is a Class B misdemeanor under section 945.02, but free-entry sweepstakes play has never been treated as betting in Wisconsin and no player has been charged. Enforcement effort has gone into unlicensed machines and, in 2026, prediction markets.

How old do I need to be to play in Wisconsin?

Sweepstakes casinos accept Wisconsin players from 18, the same age as the Wisconsin Lottery, and some brands set 21. Most tribal casinos and sportsbooks require players to be 21, and every sweepstakes site verifies age and identity before the first prize redemption.

Does Wisconsin have online casinos?

No. Real-money online casinos are not legal in Wisconsin and no bill proposes them. Legal options are the tribal casinos, retail sportsbooks (with statewide mobile betting coming under Act 247), the Wisconsin Lottery, charitable bingo and raffles, and daily fantasy sports.
