Are sweepstakes casinos legal in Oklahoma?

Sweepstakes casinos are still available in Oklahoma today, but a ban takes effect on November 1, 2026. Senate Bill 1589, authored by Senator Todd Gollihare and carried in the House by Speaker Kyle Hilbert and Representative Scott Fetgatter, was vetoed by Governor Kevin Stitt on May 7, 2026 and overridden by the Legislature a week later. From November 1 it becomes a felony to operate, or to knowingly support, an online casino game that lets players risk any representative of value, a definition written to capture the Gold Coins and Sweeps Coins dual-currency model.

Until the effective date, the usual analysis applies. Oklahoma law, like most states’, defines gambling around consideration, chance and prize. A promotional sweepstakes with a genuine free entry route removes consideration, so the dual-currency sites have operated in Oklahoma for years without state action. SB 1589 closes that argument for online casino-style games rather than banning promotional sweepstakes generally: it targets games that simulate slots, lottery, bingo and other casino formats and that offer both free and purchased tokens.

Timeline

• February 2, 2026: SB 1589 is introduced in the Senate and referred to the Business and Insurance Committee, which reports it do pass as amended on February 19. A House companion, HB 4130, clears two House committees unanimously the same month.
• March 2, 2026: the Senate passes SB 1589 by 48-0.
• April 2026: the House Criminal Judiciary Committee (April 7) and the Judiciary and Public Safety Oversight Committee (April 14) approve the bill.
• May 4, 2026: the House passes SB 1589 by 65-21; it is enrolled and sent to the Governor on May 5.
• May 7, 2026: Governor Stitt vetoes the bill, writing that it is “so broad that it criminalizes everyday apps people use for fun” and objecting to a new felony that extends criminal liability to businesses and service providers.
• May 14, 2026: the Senate overrides the veto 34-10 and the House 68-19, both above the two-thirds threshold, and the act is filed with the Secretary of State.
• November 1, 2026: SB 1589 takes effect.

Oklahoma joined Indiana, Maine and Tennessee among the states that enacted sweepstakes bans in 2026, following California, Connecticut, Montana, New Jersey and New York in 2025.

How Oklahoma law treats sweepstakes and gambling

Oklahoma’s gambling offences sit in Title 21 of the Oklahoma Statutes, where opening or conducting a commercial gambling game is a felony. Legal gambling is carved out by the State-Tribal Gaming Act (Title 3A), approved by voters in 2004, which authorises Class III gaming at tribal casinos and electronic games at two racetracks, plus the Oklahoma Lottery.

SB 1589 adds to Title 21. Its key features:

• Scope: online casino games in which players risk any representative of value, defined to include a currency that can be exchanged for any prize, award, cash or cash equivalent. Games that simulate slots, lottery, bingo and similar formats and that mix free and purchased tokens are covered.
• Who is liable: the operator’s owners and employees, plus any geolocation provider, gaming supplier, platform provider, promoter or media affiliate who deals or provides support for the game. Players are not named.
• Penalty: a new felony offence (reported at passage as a Class C2 felony under Oklahoma’s classification scheme), carrying a fine of $500 to $2,000 plus imprisonment.
• Exemption: gaming conducted by tribal nations under the Indian Gaming Regulatory Act and their compacts. Oklahoma’s tribal gaming leaders supported the bill.

What Oklahoma players should check

• The date: November 1, 2026. Redeem Sweeps Coins before then; redemptions can take several days to process and identity checks add time.
• Operator notices: watch your email and each site’s Oklahoma terms for earlier account-closure dates.
• Age: 18 at most sweepstakes casinos, in line with Oklahoma’s lottery age and many tribal casinos; some sites require 21.
