Are sweepstakes casinos legal in North Carolina?

Yes. Online sweepstakes casinos are available to North Carolina players, no bill to ban them has been filed in the 2025-2026 session, and every major dual-currency brand accepts the state. That may surprise anyone who remembers North Carolina’s decade-long war on sweepstakes cafes, so the distinction matters.

North Carolina’s gambling statute, G.S. 14-292, makes it a Class 2 misdemeanour to operate or play any game of chance at which money or property is bet. The usual three elements apply: consideration, chance and prize. Sweepstakes casinos remove consideration by giving Sweeps Coins away free with Gold Coin purchases, through daily bonuses and by mail-in request, so a player never has to bet anything to win.

The state’s famous sweepstakes law is G.S. 14-306.4, enacted in 2010. It bans operating an electronic machine or device to conduct a sweepstakes through an entertaining display such as video poker or video bingo. It was written for the strip-mall internet sweepstakes cafes that sold phone cards or internet time and let customers reveal prizes on slot-style terminals. The North Carolina Supreme Court upheld the law unanimously in Hest Technologies v. State in December 2012, ruling that it regulated conduct rather than protected speech. Alcohol Law Enforcement agents still raid cafes that try to dodge it with pre-reveal or skill features. The statute targets machines placed in North Carolina businesses, though, not a website a player opens on their own phone at home, and no court or agency has tried to apply it to online sweepstakes casinos. We are not lawyers; read each site’s North Carolina terms before you play.

Recent developments

  • 2010: the General Assembly passes G.S. 14-306.4 to shut down internet sweepstakes cafes.
  • December 14, 2012: the North Carolina Supreme Court upholds the law in Hest Technologies v. State ex rel. Perdue.
  • March 11, 2024: legal online sports betting launches with eight licensed operators, including FanDuel, DraftKings, BetMGM, Caesars, bet365, Fanatics, ESPN BET and Underdog. Governor Roy Cooper places a ceremonial first bet.
  • 2025: House Bill 999 proposes a licensed video gaming terminal framework for bars and other venues under the Lottery Commission. It addresses physical machines only and does not touch online sweepstakes. It had not become law at our last check.
  • 2025-2026: Attorney General Jeff Jackson calls for federal help against illegal offshore gambling sites, describing them as operating without guardrails. His statements concern unlicensed offshore sportsbooks and casinos, not sweepstakes casinos.
  • May 2026: the first phase of the permanent Catawba Two Kings Casino opens in Kings Mountain with more than 1,300 slot machines and 22 table games, replacing the temporary facility that had operated since 2021.
  • 2025-2026: no bill targeting online sweepstakes casinos is introduced and no operator adds North Carolina to its restricted list.

How North Carolina law treats sweepstakes and gambling

Gambling offences sit in Article 37 of Chapter 14 of the General Statutes. Playing an unlawful game of chance is a Class 2 misdemeanour under G.S. 14-292; operating slot machines or video gaming machines outside the tribal casinos is a more serious offence, and repeat violations of the sweepstakes-machine law can be felonies. Alcohol Law Enforcement, part of the Department of Public Safety, is the lead enforcement agency for illegal gaming machines. The North Carolina State Lottery Commission regulates the lottery and, since 2024, sports wagering and pari-mutuel betting. Tribal casinos are regulated under federal law and the state compact.

Nobody in North Carolina has been charged for playing an online sweepstakes casino. The state’s enforcement energy has gone into physical machines and, more recently, offshore betting sites. Complaints about a sweepstakes operator’s promotions can be made to the Attorney General’s Consumer Protection Division.

What North Carolina players should check

  • Age: most sweepstakes casinos accept North Carolinians at 18, the same as the state lottery. VGW’s brands, including Chumba Casino and LuckyLand Slots, require 21, and North Carolina sets 21 for sports betting and the casinos.
  • Play on your own device. The machine ban in G.S. 14-306.4 is about terminals in businesses. A cafe or store offering sweepstakes play on its own screens is the kind of operation that gets raided; your phone at home is not.
  • Location: operators verify your state by geolocation. Neighbouring Virginia, Tennessee and South Carolina differ: Tennessee banned the model in May 2026, so an account used across that border will be restricted.
  • Identity checks: expect KYC verification before your first redemption.
  • Taxes: prizes are income for federal and North Carolina tax purposes; operators issue tax forms above the federal thresholds.

Other legal ways to play in North Carolina

North Carolina has three tribal casinos: Harrah’s Cherokee, open since 1997, and Harrah’s Cherokee Valley River in Murphy, both run by the Eastern Band of Cherokee Indians, and the Catawba Nation’s Two Kings Casino in Kings Mountain, whose permanent resort is being completed in phases. All three have retail sportsbooks. The North Carolina Education Lottery has sold tickets since 2006 and offers online draw game purchases and digital instants. Online sports betting has been legal since March 11, 2024 for players aged 21 and over, and the same 2023 law regulates daily fantasy sports and authorised pari-mutuel wagering on horse racing. Charities run bingo and raffles. There is no legal online casino, and the General Assembly has not advanced an online casino bill.

Staying up to date

We monitor the General Assembly for sweepstakes, video gaming and online casino bills, Attorney General and Alcohol Law Enforcement actions and every operator’s North Carolina policy. The casino list and legal status on this page are updated as soon as anything changes, and the review date in the header shows when we last checked.

North Carolina sweepstakes casino FAQs

Are sweepstakes casinos legal in North Carolina?

Yes. No North Carolina statute, regulation or bill targets online sweepstakes casinos, and the major brands accept North Carolina players. Because Sweeps Coins are given away free, the sites lack the consideration element of gambling under G.S. 14-292, and the state’s 2010 sweepstakes law applies to physical machines in businesses.

Didn’t North Carolina ban sweepstakes?

It banned sweepstakes machines. G.S. 14-306.4, passed in 2010 and upheld by the state Supreme Court in Hest Technologies v. State in 2012, prohibits operating electronic terminals in businesses that reveal sweepstakes results through slot-style displays. It targets the internet cafe model, not a website you use on your own device at home.

How old do I have to be to play sweepstakes casinos in North Carolina?

Most operators accept North Carolina players at 18, matching the lottery age. VGW’s Chumba Casino, LuckyLand Slots and Global Poker require 21, and North Carolina sets 21 for online sports betting and its tribal casinos. Check the age clause in each site’s terms before registering.

Is online casino gambling legal in North Carolina?

No. North Carolina legalised online sports betting in March 2024 and regulates daily fantasy sports, but it has not authorised online casino games, and no online casino bill has advanced in the General Assembly. Casino-style gambling is legal only at the three tribal casinos.

Where can I gamble legally in North Carolina?

At Harrah’s Cherokee, Harrah’s Cherokee Valley River and Catawba Two Kings Casino, each with a retail sportsbook; through eight licensed online sportsbooks for players 21 and over; through the North Carolina Education Lottery, including online purchases; and at charity bingo and raffle events. The lottery age is 18.
