Are sweepstakes casinos legal in Kentucky?

Sweepstakes casinos are not banned in Kentucky, but the state is one of the riskiest in the country for operators, and more than 30 brands refuse Kentucky players. No statute names the model and no bill to ban it has passed. The exclusions are voluntary and come down to two things: a 19th-century law that lets almost anyone sue a gambling winner for triple the losses, and an Attorney General who in June 2026 skipped the cease-and-desist letter and went straight to court against the biggest operator in the business.

Kentucky’s gambling definitions follow the standard test. Under Chapter 528 of the Kentucky Revised Statutes, gambling means staking or risking something of value on the outcome of a contest, game or gaming scheme based on an element of chance in return for the chance to win something of value. Sweepstakes casinos argue there is no stake: Gold Coins are bought for entertainment, and the prize-redeemable Sweeps Coins are given away with purchases, as bonuses and through a free mail-in route. Attorney General Russell Coleman’s position, filed in Franklin Circuit Court on June 17, 2026, is that VGW’s virtual coins function as casino chips and that Chumba Casino, LuckyLand Slots, LuckyLand Casino and Global Poker are unlicensed online casinos. VGW says it respectfully but completely disagrees and will vigorously defend the case. No court has ruled yet.

Availability is patchy as a result. Chumba, Pulsz and Funzpoints have historically accepted Kentucky players; Stake.us, High 5, McLuck, Hello Millions, Jackpota, Mega Bonanza, Fliff, Spree and dozens of smaller brands list Kentucky as excluded. Recent developments

• 2011-2021: the Commonwealth sues PokerStars under the Loss Recovery Act over roughly $290 million lost by Kentuckians between 2007 and 2011. The Kentucky Supreme Court reinstates a judgment that had grown past $1.3 billion with penalties, and Flutter settles for $300 million in 2021. The case proves the statute reaches online operators.
• 2023: VGW settles a Kentucky class action brought under the Loss Recovery Act for $11.75 million. Yellow Social Interactive (Pulsz) later settles two similar claims for a combined $4.9 million and Woopla (Funzpoints) for more than $800,000. All three keep serving Kentucky.
• 2024-2025: rather than absorb that exposure, operator after operator quietly adds Kentucky to its excluded states. By December 2025, 33 brands list Kentucky as excluded, without a single cease-and-desist letter having been issued.
• April 1-14, 2026: the General Assembly passes HB 904, the Wagering Consumer Protection Act, sponsored by Representative Michael Meredith, 64-19 in the House and 24-13 in the Senate. Governor Andy Beshear vetoes it on April 13 over a clause letting regulators issue rules without his review; lawmakers override the veto on April 14. The law raises the sports-betting age from 18 to 21, licenses daily fantasy sports, bars licensees from partnering with prediction markets and allows fixed-odds racing bets. It does not mention sweepstakes casinos.
• June 17, 2026: Attorney General Coleman files three lawsuits in Franklin Circuit Court, against Kalshi, Polymarket and VGW, alleging illegal gambling and consumer-protection violations. The VGW complaint seeks civil penalties and an order that the company leave Kentucky.
• September 14, 2026: VGW closes LuckyLand Slots nationwide; Chumba Casino and Global Poker continue to operate while the lawsuit proceeds.

How Kentucky law treats sweepstakes and gambling

Two bodies of law matter. Chapter 528 of the Kentucky Revised Statutes criminalises promoting gambling, with a felony for first-degree promotion and misdemeanors for lesser offences, and it is aimed at operators rather than casual players. The Loss Recovery Act, KRS 372.020 and 372.040, is civil: a person who loses money gambling can sue the winner to recover it, and if the loser does not sue within six months, any other person may sue for treble the amount within five years. Kentucky courts have held that an online operator is the winner for these purposes, even in player-versus-player games. The Attorney General’s 2026 complaint adds the Consumer Protection Act, which allows civil penalties per violation.

The Kentucky Horse Racing and Gaming Corporation, created in 2024 to replace the Horse Racing Commission, regulates racing, historical horse racing machines, sports wagering and charitable gaming. The Kentucky Lottery Corporation runs the lottery. Neither has acted against sweepstakes casinos; the pressure has come from private plaintiffs and the Attorney General.

What Kentucky players should check

• Eligibility: check the excluded-states list before registering. More than 30 brands block Kentucky, and a Kentucky address will fail verification at those sites.
• Minimum age: 18 at most sweepstakes casinos, matching the Kentucky Lottery and pari-mutuel wagering. Sports betting rose to 21 under HB 904; some sweepstakes brands apply 21 as well.
• The VGW lawsuit: if you play at Chumba or Global Poker, keep balances modest and redeem regularly. A court order or settlement could end Kentucky access at short notice.
• Location and identity: geolocation and KYC checks apply; a VPN breaches the terms and forfeits balances. Prizes are taxable income.
• Loss Recovery Act: the statute lets players recover gambling losses; it does not penalise them, and players face no criminal exposure.

Other legal ways to play in Kentucky

Kentucky has no commercial or tribal casinos, but its racetracks operate historical horse racing machines that look and play like slots: Derby City Gaming in Louisville, Turfway Park in Florence, Oak Grove, Ellis Park, The Red Mile in Lexington, Cumberland Run in Corbin and The Mint at Kentucky Downs. Sports betting legalised by HB 551 launched at retail on September 7, 2023 and online on September 28, 2023, regulated by the Horse Racing and Gaming Corporation. The Kentucky Lottery has operated since 1989 and sold tickets online since 2016. Churchill Downs and Keeneland anchor pari-mutuel racing, and licensed charities run bingo and pull-tabs. Real-money online casinos are not legal.
