Are sweepstakes casinos legal in Massachusetts?

Yes. Sweepstakes casinos are available in Massachusetts, no statute targets the dual-currency model, and the only ban bill filed so far was shelved in March 2026. Massachusetts defines illegal gaming and lotteries in Chapter 271 of the General Laws, using the usual elements of consideration, chance and prize. Promotional sweepstakes that offer a free way to enter fall outside those provisions, and that is the basis on which Gold Coin and Sweeps Coin sites accept Massachusetts players. The Massachusetts Gaming Commission (MGC), which licenses the state’s three casinos and its sportsbooks, has no authority over sweepstakes sites and has not issued cease-and-desist letters to any of them, although it has cautioned residents that only its licensees are regulated.

The closest the state has come to a ban is House Bill 4431, filed by Representative David Muradian on August 18, 2025. It paired legalising online casino gaming for the three existing casino licensees with a prohibition on online sweepstakes games, defined as games of chance that use a dual-currency system and simulate casino-style play, with fines of $10,000 to $100,000 per violation and up to two years in prison for repeat offences. In March 2026 the Joint Committee on Economic Development and Emerging Technologies voted 11-0 to send the bill to study, which in Massachusetts practice means it is dead for the session. We are not lawyers; the casinos on our list state that they accept Massachusetts players, but read their terms.

Recent developments

  • June 2025: Attorney General Andrea Campbell sends cease-and-desist letters to the offshore operators BetOnline.ag and SportsBetting.ag for offering unlicensed casino games and sports betting. Sweepstakes sites are not targeted.
  • August 18, 2025: Representative Muradian files H.4431, the first Massachusetts bill to propose a sweepstakes ban, alongside competing online casino bills from Representative Daniel Cahill and Senator Paul Feeney that do not mention sweepstakes.
  • August 2025: the Massachusetts Lottery awards Aristocrat Interactive the contract to build its online lottery, a signal that the state prefers a regulated online product of its own.
  • March 2026: the committee’s reporting deadline for H.4431 passes on March 16 and the committee votes 11-0 to send the bill to study, shelving both the online casino plan and the sweepstakes ban until at least the 2027-2028 session.
  • Summer 2026: Mass Lottery Online launches, giving residents their first legal online gambling product beyond sports betting.
  • September 2026: no new sweepstakes bill has been filed, and no operator has announced a Massachusetts exit.

How Massachusetts law treats sweepstakes and gambling

  • Chapter 271: the illegal gaming chapter criminalises setting up or promoting lotteries, keeping gaming houses and unlicensed betting. It predates the internet and contains no reference to virtual currencies.
  • Chapter 23K and Chapter 23N: the Expanded Gaming Act of 2011 created the MGC and the three casino licences; the 2022 sports wagering law added online and retail sportsbooks. Neither covers online casino games, which remain unauthorised.
  • Players: Massachusetts enforcement has always focused on operators. There is no record of a resident being prosecuted for playing at a sweepstakes or offshore site.
  • What H.4431 would have done: made it unlawful to operate, conduct or promote an online sweepstakes game, penalised the businesses that support one, and given the MGC oversight of a new online casino market taxed at 15 percent.

What Massachusetts players should check

  • Age: the Massachusetts Lottery is 18+, casinos and sports betting are 21+. Most sweepstakes sites accept Massachusetts players at 18, but several large brands, including McLuck, Pulsz, Mega Bonanza and PlayFame, require 21.
  • Eligibility: confirm Massachusetts is on the site’s list of eligible states.
  • Identity and location checks: expect KYC before your first redemption and geolocation on every session.
  • Taxes: prizes are taxable income; Massachusetts taxes gambling winnings at its standard income tax rate.
  • Bill watch: if a version of H.4431 is refiled in 2027, operators would normally give notice and a redemption window before any exit.

Other legal ways to play in Massachusetts

Massachusetts has three commercial casinos: Plainridge Park Casino in Plainville (slots and harness racing, opened 2015), MGM Springfield (2018) and Encore Boston Harbor in Everett (2019). The Massachusetts Lottery, one of the highest-selling in the country, began in 1972 and added online sales in 2026. Sports betting launched in retail books on January 31, 2023 and online on March 10, 2023, with DraftKings, FanDuel, BetMGM, Caesars, Fanatics and others licensed. Daily fantasy sports is legal, charitable gaming is permitted, and pari-mutuel wagering continues at Plainridge. Online casino gaming remains illegal.

Staying up to date

We track every Massachusetts gambling bill, MGC and Attorney General actions and each operator’s Massachusetts policy. This page and the casino list are updated as soon as anything changes; the review date in the header shows when we last checked.

Massachusetts sweepstakes casino FAQs

Are sweepstakes casinos legal in Massachusetts?

Yes. No Massachusetts statute prohibits dual-currency sweepstakes casinos, the Gaming Commission has no jurisdiction over them and has not sent cease-and-desist letters, and the one bill that would have banned them, H.4431, was sent to study in March 2026. The major brands accept Massachusetts players.

What was Massachusetts House Bill 4431?

H.4431, filed by Representative David Muradian on August 18, 2025, would have legalised online casino gaming for the three existing casino licensees and banned online sweepstakes games, with fines of $10,000 to $100,000 per violation. The Joint Committee on Economic Development and Emerging Technologies voted 11-0 to send it to study in March 2026.

How old do you have to be to play sweepstakes casinos in Massachusetts?

Most sweepstakes sites accept Massachusetts players at 18, matching the Lottery age. Several large brands, including McLuck, Pulsz, Mega Bonanza and PlayFame, require players to be 21, the same age as the state’s casinos and sportsbooks. Check the age clause in each site’s terms before registering.

Has Massachusetts taken action against any online gambling sites?

Yes, against offshore operators. In June 2025 Attorney General Andrea Campbell sent cease-and-desist letters to BetOnline.ag and SportsBetting.ag for offering unlicensed casino games and sports betting. No sweepstakes casino has received a letter, and the Gaming Commission has limited itself to reminding residents that only its licensees are regulated.

Are online casinos legal in Massachusetts?

No. Massachusetts allows online sports betting (since March 10, 2023) and, from summer 2026, online lottery sales, but online casino games are not authorised. Legal casino play is limited to Encore Boston Harbor, MGM Springfield and Plainridge Park Casino, all 21+. Online casino bills have stalled every session so far.
