Are sweepstakes casinos legal in Missouri?
Yes. Sweepstakes casinos are available in Missouri, no statute or regulator targets the dual-currency model, and no ban bill has advanced. Missouri defines gambling in Revised Statutes section 572.010 as staking or risking something of value on the outcome of a contest of chance or a future event outside one’s control in exchange for something of value. Sweepstakes sites take the position that free daily coins and mail-in entries mean players never stake anything of value, so the Gold Coin and Sweeps Coin model sits outside Chapter 572. The Missouri Gaming Commission regulates the state’s casinos and, since December 2025, its sportsbooks; it has taken no position on sweepstakes sites and has no jurisdiction over them.
The one live legal threat is a private lawsuit rather than a state action. Killham v. Stake, filed in Jackson County Circuit Court on October 27, 2025, alleges that Stake.us runs an illegal online casino and names the rapper Drake and the streamer Adin Ross as co-defendants for promoting it. The case relies on a Missouri statute that lets gambling losers sue to recover their losses. As of our last check no ruling on the merits has been issued. We are not lawyers; the casinos on our list state that they accept Missouri players, and you should read their terms.
Recent developments
- November 5, 2024: voters approve Amendment 2 by roughly 3,000 votes, legalising sports betting.
- 2025 session: no bill targeting sweepstakes casinos advances. The Legislature’s gambling energy goes into the long fight over unregulated slot-style machines in gas stations and bars.
- October 27, 2025: Killham v. Stake is filed in Kansas City, the first Missouri case to test the sweepstakes model.
- December 1, 2025: online sports betting launches with DraftKings, FanDuel, BetMGM, Caesars and others, giving Missourians their first legal online wagering.
- February 2026: the House narrowly passes a bill to create a state video lottery to replace grey-market machines; it stalls in the Senate, which remains resistant to expanded gambling.
- 2026 session: no sweepstakes ban bill is filed and no operator announces a Missouri exit. The session ends in May 2026 with Missouri one of the larger states where the model is untouched.
How Missouri law treats sweepstakes and gambling
- Gambling (section 572.020): knowingly engaging in gambling is a class C misdemeanor, or a class A misdemeanor for a professional player. Missouri is one of the states whose law reaches the player, though there is no record of anyone charged for online sweepstakes play.
- Promoting gambling in the first degree (section 572.030): operating a gambling device or bookmaking above modest daily thresholds is a class E felony; lesser promotion is a misdemeanor.
- Loss recovery: Missouri law allows a person who loses money at an illegal game to sue to recover it, the provision at the heart of the Stake lawsuit.
- Promotions: genuine no-purchase-necessary sweepstakes are lawful, which is the framework operators rely on.
- Regulators: the Missouri Gaming Commission for casinos, sports betting and bingo; the Missouri Lottery for its own games. Neither oversees sweepstakes sites.
What Missouri players should check
- Age: the Missouri Lottery is 18+, casinos and sports betting are 21+. Most sweepstakes sites accept Missourians at 18, but McLuck, Pulsz, Mega Bonanza and PlayFame require 21.
- Eligibility: confirm Missouri appears on the site’s list of eligible states.
- Identity and location checks: expect KYC before your first redemption and geolocation on every session.
- Taxes: prizes are taxable income in Missouri.
- Litigation watch: an adverse ruling in the Stake case could prompt operators to change their Missouri terms; we will note any exit and redemption deadline here.
