Are sweepstakes casinos legal in Hawaii?

Sweepstakes casinos are available in Hawaii and no statute or enforcement action targets them, even though Hawaii is one of only two states with no legal gambling of any kind. Hawaii and Utah are the only states without a lottery, casinos, racetracks or sports betting. That makes Hawaii’s gambling definition the whole story.

Under Hawaii Revised Statutes section 712-1220, a person gambles when they stake or risk something of value on the outcome of a contest of chance or a future contingent event not under their control, on the agreement that they will receive something of value if a certain outcome occurs. A contest of chance is any game in which the outcome depends in a material degree on chance, even if skill is also a factor. The definition needs all three elements: something of value risked, chance and a prize. Sweepstakes casinos are built to remove the first. Gold Coins are bought for entertainment and cannot be redeemed, while the prize-redeemable Sweeps Coins are given away free with purchases, through daily bonuses and via a mail-in or online entry route that costs nothing. Because nothing of value is risked to obtain Sweeps Coins, the operators’ position is that the activity is a promotional sweepstakes rather than gambling.

No Hawaii court or agency has ruled on that argument, and Hawaii’s statute is unusual in penalising players as well as promoters, so the free-entry structure matters more here than almost anywhere else. We are not lawyers; read each site’s terms and its eligible-states list before you play.

Recent developments

  • 2025: House Bill 1308, the most developed sports-betting proposal Hawaii has seen, passes the House and Senate in different forms but dies when the two chambers cannot reconcile their versions before adjournment.
  • January 2026: the Legislature opens with a stack of gambling bills: HB 2222 (a single casino in Honolulu and a Hawaii Gaming Control Commission), HB 1434 and SB 1507 (a Hawaii Lottery and Gaming Corporation) and a cruise-ship gaming proposal. All die in committee within weeks.
  • January 2026: SB 3281, introduced by a group of senators including Stanley Chang, Troy Hashimoto and Chris Lee, targets so-called fish-game arcades but defines an illegal electronic gambling device to include any sweepstakes gaming machine or similar device that awards points, credits, gift cards, cash equivalents or anything of value based in whole or in part on chance. Industry observers warn the wording is loose enough to reach online sweepstakes casinos.
  • February 24, 2026: the Senate Judiciary Committee recommends passage 4-0.
  • March 10, 2026: the full Senate passes SB 3281 25-0.
  • March 18, 2026: the House Committee on Judiciary and Hawaiian Affairs defers the bill. Chair David Tarnas says that passing it would cause problems and that the House should take things one step at a time. The deferral kills it for the 2026 session.
  • 2026: lawmakers form a Tourism and Gaming Working Group to study legalisation, with recommendations due late 2026 or early 2027.
  • September 14, 2026: VGW closes LuckyLand Slots nationwide, so Hawaii players lose one of the longer-standing brands. Chumba, Pulsz, McLuck and Crown Coins continue to accept Hawaii players.

How Hawaii law treats sweepstakes and gambling

Gambling offences sit in HRS chapter 712, part III. Section 712-1223 makes it a misdemeanor simply to knowingly participate in any gambling activity, so unlike most states Hawaii can charge players, not just operators. Promoting gambling is an offence in its own right, with a felony version for large-scale or professional promotion, and possession of a gambling device is a separate misdemeanor. The only carve-out is social gambling between individuals where nobody other than a player profits.

There is no gaming regulator because there is nothing to regulate. Enforcement falls to county prosecutors and the Department of Law Enforcement, and it has historically been aimed at illegal game rooms and fish-table arcades on Oahu, which is exactly what SB 3281 was written to address. No Hawaii agency has issued a cease-and-desist letter to an online sweepstakes operator.

What Hawaii players should check

  • Minimum age: 18 at most sweepstakes casinos. Hawaii has no lottery or casino age to compare against, so operators apply their own rule; a few require 21.
  • Free entry route: because Hawaii’s statute reaches players, only use sites that publish a genuine no-purchase entry method for Sweeps Coins.
  • Location: sites geolocate you; playing through a VPN breaches the terms and forfeits balances.
  • Identity checks: KYC verification is required before your first redemption. Cash and gift-card prizes are taxable income.
  • Redemptions: there is no state cap; each operator sets minimum and daily redemption limits. Bank transfers to Hawaii accounts can take longer than the operator’s quoted time because of time-zone cut-offs.
  • Eligible-state lists: Hawaii is occasionally left off smaller operators’ lists for no stated reason. Check before you buy anything.

Other legal ways to play in Hawaii

There are none. Hawaii has no lottery, no commercial or tribal casinos, no racetracks, no charitable bingo, no daily fantasy licensing and no sports betting, online or retail. Cruise ships that sail from Hawaii keep their casinos closed while in state waters. Every attempt to change that, including the 2025 sports-betting bill and the 2026 casino and lottery bills, has failed, and the working group’s report is the next realistic milestone. Residents who want a real casino traditionally fly to Las Vegas, which is why Nevada casinos market so heavily to Hawaii.

Staying up to date

We follow every Hawaii gambling bill, the Tourism and Gaming Working Group, prosecutor and Department of Law Enforcement actions, and each operator’s Hawaii policy. This page and the Hawaii casino list are updated as soon as anything changes, and the review date in the header shows when we last checked.

Hawaii sweepstakes casino FAQs

Are sweepstakes casinos legal in Hawaii?

No Hawaii law bans them, and the major brands accept Hawaii players. Hawaii’s gambling definition in HRS 712-1220 requires something of value to be risked, and sweepstakes casinos give away their prize-redeemable Sweeps Coins for free. No court or agency has ruled on the model, and no cease-and-desist letters have been issued.

Did Hawaii try to ban sweepstakes casinos in 2026?

Not directly. SB 3281 targeted fish-game arcades but defined illegal electronic gambling devices broadly enough to include sweepstakes gaming machines. It passed the Senate 25-0 on March 10, 2026, then the House Judiciary and Hawaiian Affairs Committee deferred it on March 18, 2026, ending it for the year.

Can players be punished for gambling in Hawaii?

Yes. Under HRS 712-1223, knowingly participating in gambling is a misdemeanor, which is stricter than most states. That is why the no-purchase-necessary entry route matters: sweepstakes casinos argue that nothing of value is risked, so the activity is a promotion rather than gambling. Only use sites that publish a free entry method.

Is there any legal gambling in Hawaii?

No. Hawaii and Utah are the only states with no legal gambling at all: no lottery, casinos, racetracks, charitable bingo or sports betting. Bills to create a Honolulu casino, a state lottery and legal sports betting all failed in 2025 and 2026, and a Tourism and Gaming Working Group is now studying the question.

Which sweepstakes casinos accept Hawaii players?

Most large brands do, including Chumba Casino, Pulsz, McLuck and Crown Coins. LuckyLand Slots closed nationwide on September 14, 2026. Our Hawaii list only shows sites that state they accept Hawaii residents; always confirm in the operator’s terms, because smaller sites sometimes omit Hawaii without explanation.
