Are sweepstakes casinos legal in Georgia?

Sweepstakes casinos are legal to play in Georgia, and every major dual-currency brand accepts Georgia players. No Georgia statute mentions online sweepstakes casinos, no bill targeting the model was filed in the 2025-2026 General Assembly, and neither the Attorney General nor the Georgia Lottery Corporation has taken public action against an operator.

The legal basis is the familiar three-part test. Under Official Code of Georgia Annotated section 16-12-20, a bet is an agreement that, dependent on chance, one stands to win or lose something of value, and a lottery is any scheme in which prizes are distributed by chance among people who have paid or promised consideration. Consideration, chance and prize must all be present for an activity to be gambling. Sweepstakes casinos remove consideration: Gold Coins are bought purely for entertainment, while the redeemable Sweeps Coins are given away with purchases, through daily bonuses and via a free entry route (usually a mail-in request) that must be equally available to everyone. As written, Georgia’s definitions do not reach that structure.

It is worth being honest about the limits of that position. No Georgia court or regulator has ruled that the model is lawful; it operates on the wording of the statute rather than any explicit approval, and Georgia has one of the most restrictive gambling constitutions in the country. We are not lawyers, and you should read each site’s terms and its list of eligible states before you play.

Recent developments

  • April 2013: the Georgia Lottery Corporation takes over regulation of Class A and Class B coin-operated amusement machines (COAMs), the skill-game terminals found in convenience stores. That remains the state’s only regulated machine gaming.
  • 2025: House Bill 680 and Senate Resolution 285 restart the debate over putting sports betting or casinos on the November 2026 ballot. Neither reaches a floor vote.
  • March 6, 2026: on Crossover Day, the House rejects HR 450, the constitutional amendment that would have let voters decide on sports betting, by 63 votes to 98, far short of the 120 needed. Its companion bill, HB 686, which would have had the Georgia Lottery Corporation administer 16 sports-betting licences, dies with it.
  • April 2026: HB 910, an attempt to legalise mobile sports betting through the Lottery without a constitutional amendment, fails to reach the governor before adjournment. It is the fifth straight year a Georgia sports-betting bill has died.
  • 2025-2026: no bill mentioning online sweepstakes casinos is filed and no cease-and-desist letters are issued. Georgia stays open while neighbouring Tennessee bans the dual-currency model with SB 2136, signed May 22, 2026.

How Georgia law treats sweepstakes and gambling

Gambling offences sit in Title 16, Chapter 12, Article 2 of the Georgia Code. Simple gambling under section 16-12-21, which covers betting on a game or contest or playing cards, dice or balls for money, is a misdemeanor. Commercial gambling under section 16-12-22, which covers operating a gambling place or selling chances, is a felony punishable by one to five years in prison, a fine of up to $20,000, or both. The Georgia Constitution separately prohibits all lotteries, pari-mutuel betting and casino gambling except the state-run lottery, which is why sports-betting supporters have argued for years over whether an amendment is required.

Georgia has no gaming commission. The Georgia Lottery Corporation regulates the lottery and COAMs, and local prosecutors and the Attorney General handle gambling crimes. None of these provisions has been applied to online sweepstakes players, and the operators’ no-purchase-necessary structure is designed to keep them outside the definitions above.

What Georgia players should check

  • Minimum age: 18 at most sweepstakes casinos, in line with the Georgia Lottery’s age limit. A few brands, including Stake.us, set 21.
  • Location: sites verify that you are physically in Georgia with geolocation. Using a VPN breaches the terms and can forfeit your balance.
  • Free entry: every legitimate site publishes a free way to obtain Sweeps Coins, usually a postal request. If a site has no free route, it is not a sweepstakes.
  • Identity checks: expect KYC verification before your first redemption. Prizes are taxable income, and operators issue tax forms for larger redemptions.
  • Do not confuse COAMs with sweepstakes casinos: Georgia’s store-based Class B machines are legal only because they never pay cash. Online sweepstakes casinos are a different product operating under a different legal theory.

Other legal ways to play in Georgia

Georgia has no commercial casinos, no tribal casinos, no racetracks, no legal online casino and no legal sports betting, and the March 2026 votes mean nothing will change before 2027 at the earliest. The Georgia Lottery, approved by voters in 1992 and selling tickets since 1993, funds the HOPE scholarship and pre-kindergarten programmes and sells draw games and instant games online through its own app. Class B COAMs in licensed retail locations pay winnings in store merchandise or lottery products rather than cash. Licensed nonprofits can run charitable bingo and raffles. Daily fantasy sports sites operate in Georgia without a state licensing framework.

Staying up to date

We track every Georgia gambling bill, Attorney General statement and Lottery Corporation notice, along with each operator’s Georgia policy. This page and the Georgia casino list are updated as soon as anything changes, and the review date in the header shows when we last checked.

Georgia sweepstakes casino FAQs

Are sweepstakes casinos legal in Georgia?

Yes. Georgia has no statute, bill or enforcement action aimed at online sweepstakes casinos. Because players can obtain Sweeps Coins without buying anything, the model falls outside the consideration element of Georgia’s gambling definitions in OCGA 16-12-20. Every major dual-currency brand currently accepts Georgia players.

How old do I have to be to play sweepstakes casinos in Georgia?

Most sweepstakes casinos require Georgia players to be at least 18, the same age the Georgia Lottery uses. Some brands, including Stake.us, set their own minimum at 21. Always check the age requirement in the site’s terms before registering, because accounts that fail verification lose their balances.

Has Georgia tried to ban sweepstakes casinos?

No. Through the 2026 session the General Assembly focused on sports betting and casino expansion, and both failed: HR 450 was defeated 63-98 on March 6, 2026 and HB 910 died at adjournment. No Georgia bill has mentioned online sweepstakes casinos, and no cease-and-desist letters have been issued.

Can I play at a real online casino or sportsbook in Georgia?

No. Georgia has no legal online casinos, no sportsbooks and no land-based casinos of any kind. Legal options are limited to the Georgia Lottery, licensed Class B coin-operated amusement machines that pay in merchandise or lottery products, and charitable bingo and raffles run by licensed nonprofits.

Are sweepstakes casino prizes taxable in Georgia?

Yes. Cash and gift-card redemptions are taxable income at federal level and in Georgia, which taxes personal income. Operators collect identity details before your first redemption and issue tax forms once your annual prizes pass the reporting threshold. Keep your own records of purchases and redemptions.
