Are sweepstakes casinos legal in Nebraska?

Yes. Nebraska has no law aimed at online sweepstakes casinos, no bill to ban them has been filed in the 2025 or 2026 sessions of the Legislature, and every major dual-currency brand accepts Nebraska players. The state has been busy with gambling policy since 2020, but all of the attention has gone to racetrack casinos and sports betting rather than sweepstakes.

Nebraska’s gambling statutes, Nebraska Revised Statutes 28-1101 to 28-1117, define gambling as betting something of value on the outcome of a game of chance or a future event over which the bettor has no control. The Nebraska Constitution goes further than most states: Article III, section 24 prohibits games of chance outright unless voters have approved them, which is why the state lottery, keno, pari-mutuel wagering and, since November 2020, casino gaming at licensed racetracks each needed a public vote.

Sweepstakes casinos sit outside that framework because they are structured as promotions rather than bets. Players buy Gold Coins, a play-money currency, and receive Sweeps Coins as a free bonus, through daily logins or by mailing a request. Because a free route to the prize currency always exists, operators argue that no consideration is paid for the chance to win and the activity is not gambling. Nebraska has never tested that argument in court or in legislation. We are not lawyers, and we list the sites that accept Nebraska players for information only.

Recent developments

  • November 2020: voters approve Initiatives 429, 430 and 431, amending the constitution to allow casino gaming at licensed horse racetracks and creating the Nebraska Racing and Gaming Commission’s casino oversight role.
  • June 22, 2023: the first legal sports bet in Nebraska is placed at WarHorse Casino Lincoln. Betting is retail-only, at casino windows and kiosks.
  • May 17, 2024: Harrah’s Columbus opens as the state’s first fully built racetrack casino. WarHorse Omaha follows in August 2024, the permanent WarHorse Lincoln on November 4, 2024 and Grand Island Casino Resort at Fonner Park on April 10, 2025.
  • April 16, 2025: LR 20CA, Senator Eliot Bostar’s proposed constitutional amendment to let voters legalise online sports betting, clears its first floor vote 27-16 but stalls; it is withdrawn in the 2026 session for lack of votes. Senator Stan Clouse’s LB 421, a statutory framework for online betting, never leaves committee.
  • July 1, 2026: the group Tax Relief Nebraska submits more than 201,000 signatures for a constitutional amendment authorising online sports wagering and about 146,000 for an accompanying statute on regulation and tax.
  • August 21, 2026: the Secretary of State certifies both petitions for the November 2026 ballot, with 138,473 valid signatures against a requirement of 127,054 for the amendment and 96,918 against 88,938 for the statute.
  • 2025-2026: no bill targeting online sweepstakes casinos is introduced. A 2026 gaming bill would let nonprofits run gift enterprises, Nebraska’s legal term for promotional sweepstakes, as fundraisers; it does not touch online casinos.

How Nebraska law treats sweepstakes and gambling

Nebraska’s criminal code punishes promoting gambling, possessing gambling devices and running gambling operations; simple participation is treated far more lightly. The heavy lifting on regulation is split between the Nebraska Racing and Gaming Commission, which licenses the racetrack casinos and their retail sportsbooks, and the Charitable Gaming Division of the Nebraska Department of Revenue, which oversees keno, bingo, pickle cards and raffles. The Nebraska Lottery is its own state agency.

None of these bodies licenses or supervises sweepstakes casinos, and none has issued a public warning or cease-and-desist letter to one. The Nebraska Attorney General has consumer protection powers over deceptive promotions, and a sweepstakes that failed to honour its free entry route or its published odds could be challenged under those rules. In practice the sites operate exactly as they do in the other legal states.

What Nebraska players should check

  • Age: most sweepstakes casinos accept Nebraskans at 18, but VGW brands such as Chumba Casino and LuckyLand Slots require 21, and Nebraska’s own gambling ages are 19 for the lottery and keno and 21 for the racetrack casinos. Check each site’s terms.
  • Location: operators use geolocation. If you live near Omaha and cross into Iowa, your eligibility does not change, since Iowa also permits the sites, but your account will be flagged if you appear in a banned state.
  • Identity checks: expect KYC verification before your first redemption.
  • Redemption rules: Nebraska imposes no state cap on sweepstakes prizes; the limits you see are the operator’s own minimums, maximums and daily caps.
  • Taxes: sweepstakes prizes are income for federal and Nebraska tax purposes, and operators issue tax forms above the federal thresholds.

Other legal ways to play in Nebraska

Nebraska now has real casinos. Licensed racetrack casinos operate at WarHorse Lincoln, WarHorse Omaha, Harrah’s Columbus and Grand Island Casino Resort, with a fifth licence tied to the Atokad track in South Sioux City. Each may offer slots, table games and a retail sportsbook; wagers on Nebraska college teams playing at home are not allowed. Four tribal casinos also operate: Ohiya Casino and Resort near Niobrara, run by the Santee Sioux Nation, Native Star in Winnebago and Iron Horse in Emerson, run by the Winnebago Tribe, and Lucky 77 in Walthill, run by the Omaha Tribe.

The Nebraska Lottery has sold tickets since 1993, and keno, run by cities and counties in bars and restaurants, is a Nebraska institution. There is no legal online casino, online poker or online sportsbook; whether mobile sports betting arrives depends on the two measures on the November 2026 ballot.

Staying up to date

We monitor every Nebraska session for bills touching sweepstakes or online gaming, the November 2026 sports betting vote and each operator’s Nebraska policy. The casino list and legal status on this page are updated as soon as anything changes, and the review date in the header shows when we last checked.

Nebraska sweepstakes casino FAQs

Are sweepstakes casinos legal in Nebraska?

Yes. Nebraska has no statute, regulation or enforcement action aimed at online sweepstakes casinos, and no bill to ban them was filed in the 2025 or 2026 legislative sessions. The sites operate as promotional sweepstakes with a free entry route, which keeps them outside the state’s definition of a bet, and the major brands accept Nebraska players.

How old do I have to be to play sweepstakes casinos in Nebraska?

Most operators accept Nebraska players at 18. VGW’s Chumba Casino, LuckyLand Slots and Global Poker require 21. Nebraska’s own minimums are 19 for the lottery and keno and 21 for the racetrack casinos, so always check the age clause in a site’s terms before you register.

Is online gambling legal in Nebraska?

No. Nebraska has no legal online casino, online poker or mobile sportsbook. Sports betting is legal only in person at the licensed racetrack casinos. Two petitions certified in August 2026 will ask voters in November 2026 whether to authorise online sports wagering; online casino games are not on the ballot.

Has Nebraska tried to ban sweepstakes casinos?

Not so far. Unlike Montana, Connecticut, New Jersey, New York and California, Nebraska has seen no sweepstakes ban bill and no regulator warning. The Legislature’s gambling debates since 2020 have focused on racetrack casinos and whether to let voters decide on online sports betting.

Where can I gamble legally in Nebraska?

At the racetrack casinos in Lincoln, Omaha, Columbus and Grand Island, which offer slots, tables and retail sports betting, at the four tribal casinos in the north-east of the state, through the Nebraska Lottery and at the keno parlours found in bars across Nebraska. Casinos require players to be 21; the lottery and keno require 19.
