Are sweepstakes casinos legal in Illinois?

Sweepstakes casinos are still available in Illinois, but the state regulator says they are illegal and has told 65 of them to leave. On February 5, 2026 the Illinois Gaming Board (IGB), working with Attorney General Kwame Raoul, sent cease-and-desist letters to 65 online casino and sweepstakes operators, including Chumba Casino, LuckyLand Slots, Global Poker, Pulsz, Fliff, Legendz, JefeBet, Stake.us, Modo and High 5. The letters demanded that operators either block Illinois residents or stop offering cash, gift cards and other prizes, and warned of civil or criminal penalties. IGB Administrator Marcus Fruchter said illegal online gambling operations threaten consumer protections and undermine responsible gaming safeguards.

The IGB’s legal position is simple: a dual-currency platform that lets Illinois residents redeem prizes for cash is an unlicensed online casino under the Illinois Criminal Code, whatever it calls itself. Operators disagree. Their argument is the standard one: Gold Coins are bought for entertainment, Sweeps Coins are given away free (with purchases, as bonuses and through a mail-in request), so there is no consideration and therefore no gambling. No Illinois court has ruled on the dispute, and as of this review only two recipients, JefeBet and Jumbo88, are confirmed to have complied. Most of the largest brands continue to accept Illinois players.

That makes Illinois a watch state: open today, but with a regulator on record, letters already sent and two bills waiting in Springfield. We are not lawyers; read each site’s Illinois terms before you play.

Recent developments

  • February 2025: Senator Bill Cunningham introduces SB 1705, which would classify sweepstakes casino products as illegal gambling devices and make operating one a Class 4 felony carrying up to three years in prison. It clears a Senate committee in April 2025 and then stalls.
  • February 5, 2026: the IGB and Attorney General issue 65 cease-and-desist letters, the largest single enforcement action against sweepstakes operators in any state.
  • February 2026: Cunningham files SB 3439, which rewrites the definition of gambling device to include any electronic machine or device that offers entry into a sweepstakes dependent on chance in exchange for anything of value. It misses the March 27 committee deadline and does not move.
  • March 10, 2026: Smiles Casino leaves Illinois; WOW Vegas and Rolla follow on May 1, Mega Frenzy on April 30 and Onyx Odds on May 12.
  • May 31, 2026: the spring session ends without SB 1705 or SB 3439 passing. HB 4797, the fourth attempt to legalise real-money online casinos, also stalls in committee.
  • June 6, 2026: Blazesoft withdraws Yay Casino, Zula Casino and Luck Party from Illinois.
  • August 3, 2026: VGW stops Sweeps Coins purchases at LuckyLand Slots in Illinois ahead of closing the brand nationwide on September 14, 2026. Chumba Casino and Global Poker remain open to Illinois players.

How Illinois law treats sweepstakes and gambling

Gambling offences are in Article 28 of the Criminal Code of 2012 (720 ILCS 5/28-1). A person commits gambling by playing a game of chance or skill for money or other thing of value, and the same section separately prohibits operating an internet site that lets people play games of chance for money. Gambling is a Class A misdemeanor for a first offence and a Class 4 felony for repeat offences; keeping a gambling place and syndicated gambling carry felony penalties. The Illinois Gambling Act and the Sports Wagering Act set out what is licensed: casinos, video gaming terminals, sports wagering and horse racing.

The IGB regulates 17 casinos, close to 9,000 video gaming locations and 14 sportsbooks; the Illinois Lottery is a separate department. The IGB’s letters and both Cunningham bills are aimed at operators, payment processors and platform providers. Nothing filed or sent so far creates a new offence for players, and there is no record of an Illinois resident being charged for playing a sweepstakes casino.

What Illinois players should check

  • Minimum age: 18 at most sweepstakes casinos, in line with the Illinois Lottery. Several brands apply 21 to Illinois to match the casino age; NoLimitCoins dropped its Illinois minimum from 21 to 18 in October 2025.
  • Exit notices: operators that leave give a short window to redeem Sweeps Coins. Keep your KYC verification current so a redemption is not delayed by paperwork.
  • Location: geolocation confirms you are in Illinois; a VPN breaches the terms and forfeits balances.
  • Redemption limits: no state cap applies; each site sets minimums and daily maximums. Prizes are taxable income.
  • Chicago-area confusion: Illinois has thousands of licensed video gaming terminals in bars and truck stops. Those are regulated gambling machines and have nothing to do with online sweepstakes sites.

Other legal ways to play in Illinois

Illinois is one of the largest regulated markets in the country. There are 17 casinos, from the riverboats in Joliet, Aurora, Elgin and East St. Louis to newer venues such as Hard Rock Rockford, Wind Creek Chicago Southland and Bally’s temporary Chicago casino at the Medinah Temple, with the permanent Bally’s Chicago due in 2027. Around 48,700 video gaming terminals operate in nearly 9,000 licensed locations. Online and retail sports betting launched in March 2020 and now has 14 sportsbooks. The Illinois Lottery sells draw games online. Horse racing continues at Hawthorne and FanDuel Sportsbook and Horse Racing in Collinsville. Real-money online casinos remain illegal after HB 4797 stalled in 2026.

Illinois sweepstakes casino FAQs

Are sweepstakes casinos legal in Illinois?

They are available but contested. No Illinois statute names sweepstakes casinos, but on February 5, 2026 the Illinois Gaming Board and Attorney General sent 65 cease-and-desist letters calling dual-currency sites illegal online casinos. Most large brands, including Chumba, Pulsz, Fliff and High 5, still accept Illinois players while the dispute is unresolved.

Which sweepstakes casinos have left Illinois?

JefeBet and Jumbo88 complied with the February 2026 letters. Smiles Casino left in March, Mega Frenzy, WOW Vegas, Rolla and Onyx Odds in April and May, and Blazesoft’s Yay, Zula and Luck Party in June 2026. LuckyLand Slots stopped Illinois purchases on August 3 before closing nationwide on September 14, 2026.

Has Illinois passed a sweepstakes casino ban?

No. Senator Bill Cunningham’s SB 1705 (2025), a Class 4 felony ban, stalled after clearing committee, and his SB 3439 (2026), which redefines gambling devices to cover sweepstakes, missed its committee deadline. The spring 2026 session ended May 31 without either passing. Both could return in a future session.

Can Illinois players get in trouble for using a sweepstakes casino?

The cease-and-desist letters and both bills target operators, payment processors and platform providers, not players, and no Illinois resident has been charged for playing. The practical risk is losing access to a balance if a site leaves the state, so redeem promptly when an operator announces an Illinois exit.

Are online casinos legal in Illinois?

Not yet. HB 4797, the fourth straight online casino bill, stalled in committee in 2026. Illinois does have 17 land-based casinos, about 48,700 video gaming terminals, online sports betting since March 2020 with 14 sportsbooks, online lottery sales and horse racing, so the regulated options are extensive even without iGaming.
