Are sweepstakes casinos legal in West Virginia?

West Virginia has not banned sweepstakes casinos, but the Attorney General has treated them as unlicensed online gambling since early 2025 and most major brands have withdrawn. A shrinking group of operators still accepts West Virginia players, which is why we rate the state restricted rather than banned.

The legal backdrop is unusual. West Virginia is one of a handful of states with fully regulated real-money online casinos: the Lottery Interactive Wagering Act (House Bill 2934, passed in March 2019, now W. Va. Code chapter 29, article 22E) lets the state’s five casinos and their partners offer online slots and table games under a West Virginia Lottery Commission licence and a 15 percent tax. That framework gives the state a clear position: casino-style games offered online without a Lottery licence are illegal gambling, however the currency is labelled. The general offence in section 61-10-5, betting on games of chance, is a misdemeanor.

Attorney General JB McCuskey took office on January 13, 2025 and within weeks announced that his office was preparing subpoenas and cease-and-desist letters for sweepstakes operators, saying he had "serious concerns about West Virginia consumers, specifically our children, being targeted by illegal gambling operations". Investigative subpoenas were confirmed served in early February 2025; industry reports put the number at 47. State law bars the office from publishing them or commenting until operators respond, so the legal theory has never been aired in court. Operators did not wait to find out. We are not lawyers; read any site’s West Virginia terms before you play.

Recent developments

  • August 30, 2018: Hollywood Casino at Charles Town Races takes the state’s first legal sports bet under the Sports Wagering Act (SB 415).
  • March 2019: HB 2934 legalises online casino gaming; the first apps launch in July 2020.
  • January 13, 2025: McCuskey is sworn in as Attorney General.
  • January 29, 2025: the Attorney General announces enforcement plans; subpoenas are confirmed served by February 7.
  • February to July 2025: McLuck, Pulsz, Stake.us, Funrize and the other A1 Development brands (NoLimitCoins, TaoFortune, FunzCity, FortuneWheelz) remove West Virginia from their eligible states. The Social and Promotional Games Association calls the action misguided.
  • November 2025: VGW phases out Sweeps Coins play for West Virginians across Chumba Casino, LuckyLand Slots and Global Poker.
  • January 16, 2026: Del. Adam Burkhammer files HB 4397 and HB 4398 to raise online casino and sports betting taxes to 25 percent; neither leaves committee before the session ends on March 14, 2026. No bill to ban, license or tax sweepstakes casinos is introduced.
  • Mid-2026: roughly a dozen brands, Crown Coins and MyPrize among them, still accept West Virginia players. No public lawsuit or charge has followed the subpoenas.

How West Virginia law treats sweepstakes and gambling

  • Players: section 61-10-5 makes betting on a game of chance a misdemeanor carrying a fine of $5 to $300, with jail of 10 to 30 days only if fines and costs go unpaid. The statute predates the internet and has not been used against online sweepstakes players; the Attorney General’s action targets operators and their marketing to minors.
  • Operators: offering casino games online without a Lottery licence exposes an operator to the state’s gambling statutes and to consumer-protection claims, which is what the 2025 subpoenas were built on.
  • Regulators: the West Virginia Lottery Commission licenses casinos, sports betting, online casinos and the limited video lottery machines found in bars and clubs. Sweepstakes casinos hold no Lottery licence and are outside its complaint process. Consumer complaints go to the Attorney General’s Consumer Protection Division.

What West Virginia players should check

  • Eligibility: most large brands now list West Virginia as excluded. Check the eligible-state list before registering; if a site you use announces an exit, redeem your Sweeps Coins before the deadline it sets. VGW gave players notice in late 2025.
  • Age: sweepstakes sites require at least 18, and many set 21+, the age for the state’s regulated online casinos.
  • Location: geolocation is enforced. A VPN breaches the terms and forfeits balances.
  • Identity checks: expect KYC before a first redemption.
  • Regulated alternative: West Virginia’s licensed online casinos offer the same games with a state complaint route and deposit protections that sweepstakes sites lack.

Other legal ways to play in West Virginia

Few states offer more. The five casinos are Hollywood Casino at Charles Town Races, Mountaineer Casino Racetrack and Resort, Wheeling Island Hotel-Casino-Racetrack, Mardi Gras Casino and Resort, and the casino at The Greenbrier. Each anchors online casino and sportsbook brands, giving players around ten licensed iGaming apps, including DraftKings, FanDuel, BetMGM, Caesars, BetRivers, Golden Nugget and Fanatics, all for players 21 and over. Retail sports betting began in 2018 and mobile in 2019. The West Virginia Lottery, founded in 1986, sells draw and instant games and oversees limited video lottery terminals in licensed bars and clubs. Pari-mutuel wagering continues on thoroughbred racing at Charles Town and Mountaineer and greyhound racing at Wheeling and Mardi Gras, and nonprofits run bingo and raffles. Daily fantasy sports sites also operate in the state.

Staying up to date

We track the Attorney General’s office, the Lottery Commission, the 2027 legislative session and every operator’s West Virginia policy. The casino list and legal status on this page are updated as soon as anything changes; the review date in the header shows when we last checked.

West Virginia sweepstakes casino FAQs

Are sweepstakes casinos banned in West Virginia?

No statute bans them, but since January 2025 the Attorney General has treated them as unlicensed online gambling and served investigative subpoenas on operators. Most major brands, including McLuck, Pulsz, Stake.us and the VGW casinos, have withdrawn, while a smaller group still accepts West Virginia players.

Which sweepstakes casinos left West Virginia?

McLuck, Pulsz, Stake.us, Funrize and the other A1 Development brands left between February and July 2025. VGW ended Sweeps Coins play for West Virginians on Chumba Casino, LuckyLand Slots and Global Poker in November 2025. Our list shows only sites that state they still accept the state.

Can West Virginia players be penalised?

Betting on a game of chance is a misdemeanor under W. Va. Code 61-10-5 with a fine of $5 to $300, but the law has never been applied to online sweepstakes players. The Attorney General’s action is aimed at operators and their advertising, not at residents who play.

Why is West Virginia so hostile when it has legal online casinos?

Precisely because of that. The 2019 Interactive Wagering Act requires a Lottery Commission licence and a 15 percent tax for online casino games, so unlicensed sweepstakes sites are seen as competing with licensed operators while avoiding tax and player-protection rules.

What legal gambling does West Virginia offer?

Five casinos, around ten licensed online casino apps, retail and mobile sports betting, the West Virginia Lottery and limited video lottery terminals in bars, pari-mutuel horse and greyhound racing, charitable bingo and raffles, and daily fantasy sports. Regulated online casino play requires players to be 21.
