Are sweepstakes casinos legal in Texas?

Yes. Sweepstakes casinos are legal to play in Texas, and no statute or enforcement action targets the dual-currency model. Texas has some of the strictest gambling laws in the United States: no commercial casinos, no sports betting, no online casino, and a Penal Code that makes even the player guilty of a Class C misdemeanor for placing a bet. What it also has is a very precise definition of gambling. Under Penal Code Section 47.01, a bet is an agreement to win or lose something of value solely or partially by chance, and a lottery is a scheme in which prizes are distributed by chance among people who have paid or promised consideration for a chance to win. Consideration is the hinge.

Sweepstakes casinos are built to avoid it. Gold Coins are bought for entertainment and cannot be redeemed. Sweeps Coins, the only currency that can be turned into prizes, are given away: as a free bonus with Gold Coin purchases, through daily logins and social promotions, and by a postal request that costs nothing but a stamp. Because nobody has to pay for the chance to win, the operators say they are running a promotional sweepstakes of the kind Texas businesses run every day, not a lottery or a gambling place. Texas has never litigated that argument against an online sweepstakes casino, and every major brand accepts Texas players.

Recent developments

  • May 2025: Senate Bill 517, by Senator Mayes Middleton, passes the Texas Senate. Written to attack illegal eight-liner game rooms, it would have redefined gambling device and thing of value (to capture gift cards and similar benefits) and created new defences for genuine amusement machines with small non-cash prizes. Some analysts warned the broader definitions could reach online sweepstakes. The bill dies in the House when the 89th Legislature adjourns on June 2, 2025.
  • June 2, 2025: the session ends with none of the casino or sports betting constitutional amendments (HJR 134 and SJR 65 for sports wagering, HJR 137 and SJR 82 for destination casinos) receiving a committee vote.
  • September 1, 2025: Senate Bill 3070 abolishes the Texas Lottery Commission amid investigations into courier sales and a bulk-purchase jackpot, moving the lottery and charitable bingo to the Texas Department of Licensing and Regulation, banning ticket couriers and capping purchases at 100 tickets per person.
  • 2026: the Legislature does not meet in regular session; the next one opens in January 2027. No sweepstakes bill can be filed until then unless the Governor calls a special session on the subject.

How Texas law treats sweepstakes and gambling

Chapter 47 of the Texas Penal Code is the relevant law.

  • Section 47.02 (gambling): a person commits an offence by making a bet on a game or contest, playing a game for money with cards, dice or balls, or betting on a lottery. It is a Class C misdemeanor, the same level as a traffic ticket, and there is a defence for private social gambling where nobody but the players profits. Texas is one of the few states whose gambling law explicitly reaches players.
  • Section 47.03 (gambling promotion): operating a gambling place, bookmaking or setting up a lottery for gain is a Class A misdemeanor, with related offences for keeping a gambling place and possessing gambling devices.
  • Section 47.01(4)(B): amusement machines that pay only non-cash prizes worth no more than $5 or ten times the play cost are excluded from the definition of a gambling device. This so-called fuzzy animal exception is what the state’s controversial eight-liner game rooms rely on, and SB 517 tried to tighten it.
  • Sweepstakes law: Texas regulates promotional sweepstakes through the Business and Commerce Code (Chapter 622 covers sweepstakes conducted through the mail, with disclosure rules and a list of exemptions) and through deceptive trade practices law enforced by the Attorney General. Neither addresses online casino-style sweepstakes.

Texas has no gaming commission. The Attorney General prosecutes gambling cases and has in the past pursued the software companies behind storefront sweepstakes parlours, but has taken no action against online sweepstakes casinos. We are not lawyers; if you need certainty, read Chapter 47 or ask one.

What Texas players should check

  • Age: 18, the Texas lottery age; a few sweepstakes casinos require 21.
  • Location: geolocation is enforced. Texas is served by all major brands, and neighbouring Oklahoma will be geo-blocked from November 1, 2026 under its new law.
  • Free entry: use the daily bonuses and postal route; the absence of consideration is the whole legal basis in Texas.
  • Identity checks: expect ID verification before the first redemption, with minimums of 50 to 100 Sweeps Coins.
  • Taxes: Texas has no state income tax, but sweepstakes prizes are federal taxable income.
  • Beware imitators: offshore real-money casinos advertise heavily to Texans. They are illegal under Chapter 47 and carry none of the sweepstakes protections.

Other legal ways to play in Texas

Legal gambling in Texas is narrow. The Texas Lottery, launched in 1992 and now run by the Department of Licensing and Regulation, sells draw and scratch games. Three tribal venues offer Class II electronic bingo machines: Kickapoo Lucky Eagle in Eagle Pass, Naskila Casino in Livingston and Speaking Rock in El Paso. Pari-mutuel horse racing runs at Lone Star Park, Sam Houston Race Park and Retama Park, regulated by the Texas Racing Commission. Charitable bingo and raffles are permitted. There is no legal sports betting; the House passed a sports betting amendment (HJR 102) in 2023 only for it to die in the Senate, and nothing advanced in 2025. There is no legal online casino.

Staying up to date

Stakester will follow the run-up to the 2027 session, any special session and every operator’s Texas policy. This page and the Texas casino list are updated as soon as anything changes.

Texas sweepstakes casino FAQs

Are sweepstakes casinos legal in Texas?

Yes. Texas Penal Code Chapter 47 defines gambling and lotteries around consideration, and the no-purchase-necessary model gives away the prize-eligible Sweeps Coins free. No Texas statute, court ruling or attorney general action targets online sweepstakes casinos, and all major brands accept Texas players.

Did Texas try to ban sweepstakes casinos in 2025?

Not directly. Senate Bill 517, aimed at eight-liner game rooms, passed the Senate in May 2025 and would have broadened the definitions of gambling device and thing of value in ways some analysts thought could reach sweepstakes sites. It died in the House when the session ended on June 2, 2025.

Can I be fined for gambling in Texas?

For unlawful gambling, yes: Section 47.02 makes placing a bet a Class C misdemeanor, punishable by a fine, with a defence for private social games. Playing a genuine sweepstakes is not making a bet because no consideration is paid, so sweepstakes casino players are not committing that offence.

When could Texas next change its sweepstakes or gambling laws?

The Texas Legislature meets in regular session only in odd-numbered years, so the next opportunity is the session opening in January 2027, unless the Governor calls a special session. Any casino or sports betting expansion also needs a constitutional amendment approved by voters.

What gambling is legal in Texas?

The Texas Lottery (run by the Department of Licensing and Regulation since September 2025), three tribal Class II bingo casinos (Kickapoo Lucky Eagle, Naskila and Speaking Rock), pari-mutuel horse racing at three tracks, and charitable bingo and raffles. Commercial casinos, sports betting and online casinos are all illegal.
