Are sweepstakes casinos legal in Virginia?

Yes, for now. No Virginia statute mentions sweepstakes casinos, every major brand accepts Virginia players, and nobody has been prosecuted, but the General Assembly came within a conference committee of banning the model in 2026.

Virginia Code section 18.2-325 defines illegal gambling as making, placing or receiving any bet or wager of money or other consideration or thing of value in exchange for a chance to win a prize that depends on chance. Consideration is the element sweepstakes casinos avoid: Gold Coins are sold for entertainment only, and prize-redeemable Sweeps Coins are available free through mail-in requests, log-in bonuses and promotions. With no compulsory payment for the chance to win, operators argue no bet or wager exists.

That argument has never been tested in a Virginia court, and lawmakers tried to end it by statute. House Bill 161 from Del. Marcus Simon and Senate Bill 118 from Sen. Mamie Locke, the 2026 online casino bills, each carried language prohibiting sweepstakes that award prizes "through means such as a dual currency system of payment". Both chambers passed their own versions, but the conference committee could not reconcile them before the session adjourned on March 14, 2026. A standalone ban, SB 579, never left the Senate. Because the iGaming bills included re-enactment clauses, the same package is expected back in January 2027. We are not lawyers; check each site’s Virginia terms before you play.

Recent developments

  • January 2025: Sen. Locke’s SB 827, Virginia’s first serious online casino bill, is tabled in a Senate subcommittee pending further study.
  • January 6, 2026: HB 161 is pre-filed, pairing a 15-skin iGaming market for the five casino licensees with a sweepstakes ban and regulation by the Virginia Lottery Board.
  • January 17, 2026: Governor Abigail Spanberger takes office.
  • February to March 2026: after a rocky start in committee, the House and Senate pass differing iGaming bills (the chambers split over whether revenue goes to the general fund or education) and send them to conference.
  • March 14, 2026: the session ends without a compromise. The iGaming bills, the sweepstakes ban and the bill creating a standalone Virginia Gaming Commission all die. HB 145, taxing fantasy sports operators at 10 percent and banning contests played against the house, passes.
  • April 9, 2026: Governor Spanberger vetoes SB 756, which would have forced a casino referendum in Fairfax County.
  • April 10, 2026: she vetoes SB 661, the bill to re-legalise skill games, saying Virginia still lacks a single independent gaming regulator.

How Virginia law treats sweepstakes and gambling

  • Players: illegal gambling by an individual is a Class 3 misdemeanor under section 18.2-326, a fine of up to $500 with no jail time. Virginia has never applied it to online sweepstakes play.
  • Operators: running an illegal gambling operation is a Class 6 felony under section 18.2-328; operations lasting more than 30 days or taking more than $2,000 a day face one to ten years and fines up to $20,000.
  • Skill games: the slot-like machines once common in convenience stores have been illegal since July 2021 after a one-year grace period. Attempts to bring them back failed under Governor Youngkin in 2024 and again with the 2026 veto.
  • Regulators: the Virginia Lottery oversees casinos, sports betting and the lottery, the Virginia Racing Commission handles horse racing and historical horse racing, and the Department of Agriculture and Consumer Services regulates charitable gaming. Sweepstakes casinos are licensed by none of them. Bills to fold everything into a Virginia Gaming Commission have been debated since 2024 without becoming law.

What Virginia players should check

  • Age: 18 is the floor, matching the Virginia Lottery; several brands require 21, the age for casinos and sportsbooks.
  • Location: geolocation is enforced. Virginia borders West Virginia, where most operators have withdrawn, and Tennessee, where the model was banned in May 2026, so expect tight border checks. A VPN breaches the terms.
  • Free entry: confirm the site offers a no-purchase way to obtain Sweeps Coins.
  • Redemptions and KYC: minimum redemption amounts and identity verification before the first payout are standard.
  • Watch the calendar: if a ban passes in 2027, operators will give notice; redeem balances promptly if your site announces an exit.

Other legal ways to play in Virginia

Virginia’s gambling market has grown quickly. Rivers Casino Portsmouth opened in January 2023, Hard Rock Bristol’s permanent resort in November 2024 and Caesars Virginia in Danville in December 2024, while HeadWaters in Norfolk and Live! in Petersburg operate from temporary facilities ahead of permanent resorts. Richmond voters rejected a casino twice, and the Fairfax proposal was vetoed in 2026. Mobile sports betting launched in January 2021 for players 21 and over. The Virginia Lottery sells draw games and online instants to players 18 and over, Rosie’s Gaming Emporium venues offer historical horse racing machines alongside live racing at Colonial Downs, and charitable bingo and registered fantasy sports contests round out the list. Real-money online casinos remain illegal.

Virginia sweepstakes casino FAQs

Are sweepstakes casinos legal in Virginia?

Yes. No Virginia law prohibits the dual-currency sweepstakes model, and all major brands accept Virginia players. However, 2026 online casino bills carrying a sweepstakes ban passed both chambers before dying in conference, so the position could change in the 2027 session.

What happened to the Virginia sweepstakes ban in 2026?

HB 161 and SB 118, the online casino bills, both contained language banning sweepstakes that use a dual currency system of payment. The House and Senate passed different versions and the conference committee failed to agree before adjournment on March 14, 2026. A standalone ban, SB 579, never left the Senate.

Can Virginia players be penalised for using a sweepstakes casino?

Illegal gambling by an individual is a Class 3 misdemeanor in Virginia, a fine of up to $500, but the state has never treated free-entry sweepstakes play as gambling and no player has been charged. Enforcement effort has focused on skill machines and unlicensed operators.

How old do I have to be to play in Virginia?

Most sweepstakes casinos accept Virginia players from 18, the same age as the Virginia Lottery, while some brands require 21. Virginia’s casinos, sportsbooks and Rosie’s historical horse racing venues are 21 and over, and every site verifies age before the first redemption.

Does Virginia have legal casinos and online gambling?

Virginia has casinos in Portsmouth, Bristol and Danville, with temporary venues in Norfolk and Petersburg, mobile sports betting since January 2021, an online lottery and historical horse racing at Rosie’s venues. Real-money online casinos are not legal; the 2026 iGaming bills failed and are expected back in 2027.
