Are sweepstakes casinos legal in Kansas?

Sweepstakes casinos are legal to play in Kansas, and every major dual-currency brand accepts Kansas players. No Kansas statute mentions online sweepstakes casinos, no bill targeting the model was filed in the 2025 or 2026 sessions, and neither Attorney General Kris Kobach nor the Kansas Racing and Gaming Commission has taken public action against an operator.

Kansas defines its terms carefully, which helps here. Under K.S.A. 21-6403, a bet is a bargain in which the parties agree that, dependent on chance, one stands to win or lose something of value, and a lottery is an enterprise in which, for a consideration, participants are given an opportunity to win a prize determined by chance. Consideration, chance and prize must all be present. Kansas then says what consideration is not: mere registration without purchase of goods or services, personal attendance at an event without an admission fee, and watching or listening to a broadcast do not count. Sweepstakes casinos rely on exactly that principle. Gold Coins are bought for entertainment only, while the prize-redeemable Sweeps Coins are given away free with purchases, as daily bonuses and through a no-cost mail-in or online request that anyone can use. Because the free route is real, the operators’ position is that no consideration is paid for the chance to win.

Two cautions. First, the Racing and Gaming Commission’s own guidance notes that consideration can be indirect, for example the commercial advantage a promoter gains from the promotion, so the argument is stronger for sites whose free entry route is prominent and genuinely used. Second, no Kansas court or agency has ruled on the model either way. We are not lawyers; read each site’s terms and its list of eligible states before you play.

Recent developments

  • 1986-1987: voters approve a constitutional amendment for a state lottery and pari-mutuel wagering; the Kansas Lottery begins selling tickets in 1987.
  • 2007: the Kansas Expanded Lottery Act authorises four state-owned casinos, run by private managers but constitutionally owned by the Kansas Lottery. Boot Hill (Dodge City) opens in 2009, Kansas Star (Mulvane) in 2011, Hollywood at Kansas Speedway in 2012 and Kansas Crossing (Pittsburg) in 2017.
  • May 2022: Governor Laura Kelly signs SB 84, legalising retail and online sports betting; sportsbooks go live on September 1, 2022.
  • April 2025: lawmakers override a veto to insert a budget provision barring the Kansas Lottery from negotiating extensions of the six sportsbook contracts until June 30, 2026, pending a debate about tax rates and a possible single-operator model. The contracts themselves run to August 31, 2027.
  • 2025-2026: no bill on online casinos or sweepstakes casinos is introduced, and no cease-and-desist letters are issued. Kansas stays fully open while neighbouring Missouri launched sports betting in December 2025 and Nebraska and Oklahoma debated online expansion.
  • September 14, 2026: VGW closes LuckyLand Slots nationwide; Chumba Casino and Global Poker continue to serve Kansas.

How Kansas law treats sweepstakes and gambling

Gambling offences sit in Article 64 of Chapter 21 of the Kansas Statutes. Under K.S.A. 21-6404, gambling, which means making a bet or entering a gambling place with intent to bet, is a class B nonperson misdemeanor punishable by up to six months in jail, a fine of up to $1,000, or both. Commercial gambling under K.S.A. 21-6406, which covers operating a gambling place, receiving bets or setting up a lottery, is a nonperson felony. Possession of a gambling device and dealing in gambling devices are separate offences.

Regulation is split. The Kansas Lottery owns the games at the four state-owned casinos and holds the sports-betting contracts; the Kansas Racing and Gaming Commission licenses and polices those casinos, sports wagering and, under the compacts, tribal gaming; local prosecutors and the Attorney General pursue illegal gambling. None of these bodies has applied the statutes to online sweepstakes players or operators.

What Kansas players should check

  • Minimum age: 18 at most sweepstakes casinos, the same as the Kansas Lottery. Casinos and sportsbooks require 21, and a few sweepstakes brands, including Stake.us, also set 21.
  • Free entry: confirm the site publishes a no-purchase way to obtain Sweeps Coins. Given how Kansas defines consideration, this is the feature that keeps the model outside the gambling statutes.
  • Location: geolocation verifies that you are in Kansas; playing through a VPN breaches the terms and forfeits balances. Kansas City players should note that Missouri and Kansas policies can differ by operator.
  • Identity checks: KYC verification before your first redemption; prizes are taxable income and Kansas taxes personal income.
  • Redemption limits: no state cap; each site sets minimums and daily maximums.

Other legal ways to play in Kansas

Kansas has four state-owned commercial casinos (Boot Hill, Kansas Star, Hollywood at Kansas Speedway and Kansas Crossing) and tribal casinos including Prairie Band in Mayetta, Golden Eagle in Horton, Sac and Fox in Powhattan, 7th Street in Kansas City and Casino White Cloud. Online and retail sports betting has run since September 1, 2022 through six operators (BetMGM, Caesars, DraftKings, ESPN Bet, Fanatics and FanDuel) whose contracts expire on August 31, 2027; the legislature’s 2025 moratorium on renewal talks lapsed on June 30, 2026. The Kansas Lottery sells draw and instant games. Charitable bingo and raffles are licensed, and pari-mutuel wagering is legal in principle although the state’s racetracks have been closed for years. Real-money online casinos are not legal, and no iGaming bill was filed in 2026.

Staying up to date

We monitor Kansas legislation, Attorney General and Racing and Gaming Commission statements, the sportsbook-contract debate and every operator’s Kansas policy. This page and the Kansas casino list are updated as soon as anything changes, and the review date in the header shows when we last checked.

Kansas sweepstakes casino FAQs

Are sweepstakes casinos legal in Kansas?

Yes. Kansas has no statute, bill or enforcement action aimed at online sweepstakes casinos. Under K.S.A. 21-6403 a lottery requires consideration, and the statute says mere registration without purchase is not consideration, which is the basis for the free Sweeps Coins entry route. Every major brand accepts Kansas players.

How old do I have to be to play sweepstakes casinos in Kansas?

Most sweepstakes casinos require Kansas players to be 18, matching the Kansas Lottery. The state’s casinos and sportsbooks require 21, and a few sweepstakes brands, including Stake.us, apply 21 as well. Check the age rule in each site’s terms before registering, because failed verification forfeits the balance.

Has Kansas tried to ban or regulate sweepstakes casinos?

No. No bill mentioning online sweepstakes casinos was filed in the 2025 or 2026 sessions, and neither the Attorney General nor the Kansas Racing and Gaming Commission has issued cease-and-desist letters. Legislative attention has been on the future of the state’s six sportsbook contracts, which expire on August 31, 2027.

Are online casinos legal in Kansas?

No. Real-money online casinos are illegal in Kansas and no iGaming bill was introduced in 2026. Legal options are the four state-owned casinos, the tribal casinos, online and retail sports betting since September 2022, the Kansas Lottery and charitable bingo and raffles. Sweepstakes casinos are the only casino-style play available online.

What are the penalties for illegal gambling in Kansas?

Gambling under K.S.A. 21-6404 is a class B nonperson misdemeanor carrying up to six months in jail and a $1,000 fine, while commercial gambling under K.S.A. 21-6406 is a nonperson felony. Neither statute has been applied to sweepstakes casino players or operators, whose no-purchase entry route keeps them outside the definition of a lottery.
