Are sweepstakes casinos legal in Oregon?

Yes. Sweepstakes casinos are legal to play in Oregon, and no statute, bill or regulator action targets the dual-currency model. Oregon has no law that mentions online sweepstakes casinos at all. Their status comes from the general gambling definition in ORS 167.117: a person gambles when they stake or risk something of value on the outcome of a contest of chance, and something of value means money, property, or any token, credit or promise exchangeable for them. A sweepstakes casino argues that Gold Coins have no value outside the game and that the prize-eligible Sweeps Coins are free: bundled as a bonus with a Gold Coin purchase, handed out daily, and available by mail-in request with no purchase. With nothing of value staked, the activity is a promotional sweepstakes rather than gambling.

That is the same position the sites take everywhere, and Oregon has never tested it. The Oregon Department of Justice, which enforces gambling law and regulates charitable gaming, has not issued cease-and-desist letters to sweepstakes operators, and the Oregon Lottery has not asked lawmakers to act. All the major brands accept Oregon players.

Recent developments

  • 2025 session: no bill concerning sweepstakes casinos is introduced. Oregon holds a full session in odd years and a short session in even years.
  • 2026 short session: again no sweepstakes bill. Mid-2026 coverage confirms lawmakers have largely left the model alone and that no state agency licenses or audits sweepstakes platforms.
  • Neighbouring states: Washington and Idaho remain closed to Sweeps Coins play under long-standing law, and California’s AB 831 ban took effect on January 1, 2026. Operators have not changed their Oregon policies in response.
  • Online casino legislation: no bill to authorise commercial online casinos has been introduced, and the Oregon Lottery has not proposed an iCasino product. The only legal online gambling remains the Lottery’s DraftKings sportsbook.

How Oregon law treats sweepstakes and gambling

Oregon’s gambling offences are in ORS Chapter 167. ORS 167.122 makes it unlawful gambling in the second degree, a Class A misdemeanor, to knowingly place a bet with a bookmaker or to participate in unlawful gambling as a player. That is unusual: many states only punish operators, but Oregon technically exposes players who take part in illegal gambling. ORS 167.127 makes promoting or profiting from unlawful gambling a Class C felony. Because a genuine no-purchase-necessary sweepstakes is not gambling under ORS 167.117, playing one is not an offence, but the player-side penalty is one more reason to stick with operators that keep the free entry route real and honour mail-in requests.

The Oregon Constitution is also relevant. The 1984 measure that created the Oregon Lottery added language stating that the Legislative Assembly has no power to authorise, and shall prohibit, casinos in the state. Commercial casinos are therefore impossible without a constitutional amendment; only the nine federally recognised tribes may operate casinos, under compacts. Sweepstakes casinos sit outside that framework because they are not, in law, casinos at all.

Two regulators are relevant: the Oregon Lottery Commission, which runs the lottery, video lottery terminals and sports betting, and the Department of Justice, which enforces the criminal statutes and licenses charitable gaming. Neither oversees sweepstakes sites. We are not lawyers; read the statutes or ask one if you have a specific question.

What Oregon players should check

  • Age: 18 at most sweepstakes casinos, matching the Oregon Lottery age. Tribal casinos are mostly 21, and a few sweepstakes sites use 21 too.
  • Location: geolocation is enforced. Oregon is served, but crossing into Washington or Idaho changes what you can do; Washington blocks play entirely and Idaho accounts cannot redeem.
  • Free entry: confirm the site offers daily free Sweeps Coins and a postal entry route; that is what keeps it lawful.
  • Redemptions: minimums of 50 to 100 Sweeps Coins are typical, with ID verification before the first payout. Prizes are federally taxable and subject to Oregon income tax.
  • Video lottery habits: Oregon’s bar-based video lottery terminals are 21 and over; sweepstakes sites are a separate thing with separate rules, not a substitute.

Other legal ways to play in Oregon

Oregon’s nine federally recognised tribes operate around ten casinos, including Spirit Mountain in Grand Ronde, Chinook Winds in Lincoln City, Seven Feathers in Canyonville and Wildhorse in Pendleton. The Oregon Lottery, founded in 1985, sells draw and scratch games and has run video lottery terminals in bars and restaurants since 1992. Sports betting is a Lottery monopoly: the Scoreboard app launched in October 2019 and was replaced by DraftKings as the Lottery’s exclusive partner in January 2022, so DraftKings is the only legal online sportsbook and there is no competitive market. Pari-mutuel horse racing and advance-deposit wagering are regulated by the Oregon Racing Commission, and Oregon is a licensing hub for several national ADW platforms. There is no legal real-money online casino.

Staying up to date

Stakester monitors the Oregon Legislature, Department of Justice and Lottery for any move on sweepstakes casinos, and checks every operator’s Oregon policy. This page and the Oregon casino list are updated as soon as anything changes.

Oregon sweepstakes casino FAQs

Are sweepstakes casinos legal in Oregon?

Yes. Oregon has no statute, bill or enforcement action aimed at sweepstakes casinos. Under ORS 167.117 gambling requires staking something of value on chance; because Sweeps Coins can be obtained free through bonuses and mail-in requests, the sites operate as promotional sweepstakes, and all major brands accept Oregon players.

Can Oregon players be punished for gambling?

Oregon is one of the states whose law reaches players: ORS 167.122 makes participating in unlawful gambling as a player a Class A misdemeanor. A genuine no-purchase-necessary sweepstakes is not unlawful gambling, so playing one is not an offence, but it is a good reason to use reputable operators with real free-entry routes.

Why does Oregon have no commercial casinos?

The 1984 ballot measure that created the Oregon Lottery wrote into the state constitution that the Legislative Assembly has no power to authorise casinos and shall prohibit them. Only the nine federally recognised tribes can run casinos, under compacts, which is why Oregon has around ten tribal casinos and no commercial ones.

Is online sports betting or online casino legal in Oregon?

Sports betting is legal but is an Oregon Lottery monopoly: DraftKings has been the Lottery’s exclusive online sportsbook since January 2022, replacing the Scoreboard app launched in 2019. There is no legal real-money online casino in Oregon and no bill to create one has been introduced.

How old do I have to be to play sweepstakes casinos in Oregon?

Most sweepstakes casinos accept Oregon players from 18, which is the Oregon Lottery age. A few brands require 21, the age at most tribal casinos and for the Lottery’s video lottery terminals. Every site verifies age and identity before the first prize redemption.
